How do I enter the class action lawsuit?

No one at TT support will or can help you with your situation ... there is nothing you need to do.   If you are a covered consumer you will be contacted by the party handling the payout.

The settlement agreement covers users who used TurboTax in 2016, 2017 or 2018.   If you are one of the affected users you will receive about $30 for each of those years in which your income was $34,000 or less and in which you started in the Free Edition and were upgraded to a paid version of the software.

"Covered Consumer" means any individual, or individuals if a joint return was filed, who in Tax Years 2016, 2017, or 2018 was (1) eligible to use an Intuit IRS Free File Product; (2) began his or her tax returns using a TurboTax Free Edition Product; (3) was informed that he or she was ineligible to use a TurboTax Free Edition Product; (4) subsequently paid to use a TurboTax Paid Product, and (5) had not used the Intuit IRS Free File Product in a previous tax year.

You do not have to “sign up” or get on a list.   The payments will be sent out automatically to the affected users.   We do not know yet how soon the payments will be sent.

This article does NOT tell you how to enter the class action lawsuit.

How do I enter the class action lawsuit?

There is no class action suit to sign up for ... and the settlement that was approved doesn't need you to do anything.   You do not have to “sign up” or get on a list.   The payments will be sent out automatically to the affected users.   We do not know yet how soon the payments will be sent.

What do you mean, denied by the IRS?

The IRS can Reject an e-filed tax return for various reasons regardless of which tax preparation software used or paid tax professional used.

You would have received an email from TurboTax giving you the IRS rejection code and message.  What was the rejection code?

If the IRS rejected the tax return due to an incorrect 2020 AGI, know that the IRS has rejected thousands of e-filed tax returns for the 2020 AGI.

It unusually is because the IRS did not process the filed 2020 tax return until late in 2021 or in 2022 so that the 2020 AGI would not be in the IRS database.

You can enter a 0 (zero) for the 2020 AGI and e-file the 2021 tax return again.

How do I enter the class action lawsuit?

@Yellowrows54  Did the IRS reject your efile or did they change your refund?  The fees are to prepare the return whether you efile or print and mail it.  Doesn't matter if you're getting a refund or the IRS changes it.

If your efile is rejected for the AGI.....ENTER 0 FOR AGI. The IRS took a long time last year to process 2020 returns so the AGI didn't get entered in time.  Especially if you mailed it.  That works for most people. See,

If you can’t get it to efile you will have to print and mail it.

Be sure to attach copies of your W2s and any 1099s that have withholding on them.  You have to mail federal and state in separate envelopes because they go to different places.  Get a tracking number from the post office when you mail them for proof of filing.

I've been filing with TurboTax for the last 6 years. I need information on how to enter.

@yanaj You do not "enter" anything.

The settlement agreement covers users who used TurboTax in 2016, 2017 or 2018.   If you are one of the affected users you will receive about $30 for each of those years in which your income was $34,000 or less and in which you started in the Free Edition and were upgraded to a paid version of the software.

If you requested to have the TurboTax account fees paid from the federal tax refund that in NO way whatsoever delays your federal tax refund.

You used the TurboTax software to assist you in completing the tax return so you have to pay for the use of the software.

If you did not want to use tax preparation software then you should have not used TurboTax.  You could complete your tax return manually using the forms and schedules on the IRS website.  Then printed the tax return, signed the tax return and mailed the tax return to the IRS.

It is taking the IRS 6 months and longer for the IRS to process tax returns.

Go to this IRS website for the status of filed tax returns - https://www.irs.gov/newsroom/irs-operations-during-covid-19-mission-critical-functions-continue

As of July 22, 2022, we had 10.5 million unprocessed individual tax year 2021 returns. Of these, 1.7 million returns require error correction or other special handling, and 8.8 million are paper returns waiting to be reviewed and processed. This work does not typically require us to correspond with taxpayers but does require special handling by an IRS employee so, in these instances, it is taking the IRS more than 21 days to issue any related refund and in some cases this work could take 90 to 120 days. If a correction is made to any Recovery Rebate Credit, Child Tax Credit, Earned Income Tax Credit or Additional Child Tax Credit claimed on the return, the IRS will send taxpayers an explanation. Taxpayers are encouraged to continue to check Tax Season Refund Frequently Asked Questions.

How long you may have to wait: The IRS understands the importance of timely processing of tax returns and refund issuance. We have processed all error free returns received prior to January 2022 and continue to work the returns that need to be manually reviewed due to errors. We are continuing to reroute tax returns and taxpayer correspondence from locations that are behind to locations where more staff is available, and we are taking other actions to minimize any delays. Tax returns are opened and processed in the order received. As the return is processed, whether it was filed electronically or on paper, it may be delayed because it has a mistake including errors concerning the Recovery Rebate Credit and the Child Tax Credit, is missing information, or there is suspected identity theft or fraud. If we can fix it without contacting you, we will. If we need more information or need you to verify that it was you who sent the tax return, we will write you a letter. The resolution of these issues could take 90 to 120 days depending on how quickly and accurately you respond, and the ability of IRS staff trained and working under social distancing requirements to complete the processing of your return.

What you should do: In most instances, no further action is needed but you may check Where’s My Refund? or you can view your account. If you filed electronically and received an acknowledgement, you do not need to take any further action other than promptly responding to any requests for information. If you filed on paper, check Where’s My Refund? If it tells you we have received your return or are processing or reviewing it, we are processing your return, but it may be under review. If you filed before January 2022 and Where’s My Refund? does not have any information, your return has been opened but work on it has not begun. We’re working hard to get through the carryover inventory. Please don’t file a second tax return or contact the IRS about the status of your return.

Right, they rejected the 40 million, and TT willfully agreed to 141 million, as a "good faith effort".

TurboTax maker will pay $141M in settlement over misleading ads for free tax-filing.....

@justinemrabon  No timetable has been announced. You just have to wait.

How do I enter the class action lawsuit?

For years I've known this is suspect. My life was either too chaotic, I was making enough money or something else and it wasn't worth the effort to try to get someone on the phone with customer service. There is no email address. Always was eligible for the free file, started out for the free file and had to pay or start over with another company. And even when you do that they retain all the information you put in there which is very frustrating.

But this year, this year is a different story. I've not worked for two and a half years and I've been living off of my 401k. I definitely was eligible for free file and again was charged. To top it off I got a letter from the IRS requesting information and it's now been delayed another 8 weeks. I got an extension and I didn't file until recently.  Before sending the documents the IRS requested I got online trying to figure out what I did wrong. I still didn't see anything. In my opinion if TurboTax was making me pay for the deluxe they should have flagged something. Today I got an email saying because my refund is either delayed or I owe them money blah blah blah they are going to deduct the full fee from my checking account. B******* they are!  I'm not letting this go anymore.  Not only are they forcing people to pay for the premium service, they're not even giving the service.
