As MaryM428, above, suggests, you can’t e-file your return if someone else has claimed you as a dependent, whether you gave them permission to claim you or not.
Once your SSN has been accepted in an e-filed return, another return with your SSN won’t be accepted. You should print, sign and mail your return.
Please see the TurboTax Help articles How do I print and mail my return in TurboTax Online? or How do I print and mail a return in the TurboTax for Windows CD/Download software? as appropriate for the instructions on filing your return by mail.
I have big claimed on somebody's taxes as a dependent and haven't been able to receive any of the stimulus money can you guys help me out with this
I am on SSI disability someone has claimed me on their taxes without my permission as a dependent and I'm not receiving the stimulus money because of that what can I do about it can you help me
@Betty33 If you cannot be claimed as someone else's dependent but your return is being rejected because someone claimed you----print, sign and mail your return. It will take longer----but the IRS will process your return and then they will sort out the mix-up with whoever claimed you. If you know that a family member did this --- give them a heads up---then they can amend their return ahead of the IRS letter they will receive.
If you fear that your Social Security number is compromised, have you contacted the IRS?
Information on reporting tax fraud to the IRS can be found at this website.
The Taxpayer Guide to Identity Theft is here.
IRS form 3449-A is here.
If you have not received one or more of your stimulus checks, you will receive your payment in the form of a Recovery Rebate Credit on line 30 of your 2020 Federal tax return when you file.
After you have made contact with the IRS, they will give you information about how to file your tax return and have it processed.
Someone claimed me without permission
You will have to print and file your return by mail. Once another person has used your SSN on an e-filed return (as a filer or dependent), you cannot e-file.
The IRS will process your return and will contact you (and the person who claimed you as a dependent) for an explanation. Based on the responses they receive, they will decide who his entitled to claim you as a dependent and adjust the returns as necessary.
I need something done about my ex boyfriend filed me as a dependent without my permission..during the time I was staying there I was placed behind bars for something else personally related to myself...well long story short all my personals were left there
Someone else claimed me as dependent and my return was rejected
If someone else claimed you as dependent already, then your e-filed return will be rejected. Print, sign and mail your own return which says that you cannot be claimed as a dependent. Mailed returns are processed differently by the IRS. It will take some time (maybe even up to a year) but eventually the IRS will contact both parties and sort out who could rightfully claim the dependent. The person who wrongfully claimed the dependent will face repayment of refund $, plus penalties.
When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

Most important) Follow the IRS procedures for reporting a fraudulent return, documented here: www.irs.gov/uac/Taxpayer-Guide-to-Identity-Theft

If your Social Security number is compromised and you know or suspect you are a victim of tax-related identity theft, take these additional steps:
Kaleb Michael Cronin Claimed my children without my permission and I need help as soon as possible, I need someone to fix this issue i dont know what else I need to do but I need your help please, he only the father to one of my kids and I guess felt the need to claim all three of my children so please help cause I'm lost and don't know what I need to do, please call me for more information my number is [phone number removed] or my email [email address removed]
You will have to print and mail your return to claim the kids. The IRS will investigate and determine who can claim them. That's the only thing you can do, is to file your own return claiming them.
First, if he has already e-filed, claiming those kids, then you will not be able to e-file, because the IRS e-file system tracks the use of every Social Security number and does not allow them to be used on two different returns.
So you will have to print your return and mail it. Eventually, the IRS will noticed that the kids have been claimed by two different people and send out letters to determine who has the right to claim them.
You might look at the Taxpayer Advocate Service, although under the circumstances, they may not be able to tell you anything different from what I have said.
Finally, since you are presumably missing the Child Tax credit and/or the Earned Income credit (at least until the IRS straightens this out months from now), you might contact an attorney to see if you have a claim for relief in a civil court. We do not give out legal advice here in the Community.
My name is Angela padgett and my mother is my payee and I ant been living with my dad joesph padgett and he keep claimed me on his texas and he have no right to do that bc he don't have nothing to do with me I been living with my mother and I'm on a fixed income SSI and they said I should have gotten a stimulus check when my mother got ones but I didn't get one bc of my dad joesph padgett claimed on taxes
You will need to file a 2020 tax return. You should indicate that you "Cannot be claimed as a dependent". You will have to print, sign and mail your tax returns. You will need to be prepared to show that you do not qualify as a dependent.
The IRS will see the conflicting tax returns and send letters to all parties to show proof of their claims.
Here are the criteria below, first for qualifying child and then qualifying relative. You will need to fail both sets of tests in order to not be a dependent. The key tests normally are:
If you fail either of these tests, you are not a qualifying child
The child must be your son, daughter, stepchild, foster child, brother, sister, half brother, half sister, stepbrother, stepsister, or a descendant of any of them.
The child must be (a) under age 19 at the end of the year and younger than you (or your spouse if filing jointly), (b) under age 24 at the end of the year, a student, and younger than you (or your spouse if filing jointly), or (c) any age if permanently and totally disabled.
The child must have lived with you for more than half of the year.
The child must not have provided more than half of his or her own support for the year.
The child must not be filing a joint return for the year (unless that joint return is filed only to claim a refund of withheld income tax or estimated tax paid).
.
If you fail either of these tests, you would not be a qualifying relative.
The person can't be your qualifying child or the qualifying child of any other taxpayer.
The person either (a) must be related to you in one of the ways listed under Relatives who don't have to live with you , or (b) must live with you all year as a member of your household (and your relationship must not violate local law).
The person's gross income for the year must be less than $4,300.
You must provide more than half of the person's total support for the year.
Can the person who wrongfully claimed someone as a dependent go to jail for fraud?
