I was a WA resident in 2020. In 2020, my new employer erroneously withheld 1 month of VA income tax (roughly $1200) before I corrected it to WA (no state income tax) and because I never filed a VA non resident return for 2020, I never got that withheld money refunded to me on my federal tax return. Do I need to amend my 2020 federal tax return and file a VA 2020 non resident return to get that $1200 back?
Back in 2020 I filed a 2017 tax amend because I apparently had domicile established in 2017 for consecutively more than half the year in WA but I still paid $500+ taxes to VA when in fact I should've filed a part year non resident return to VA and the time I earned the income was in WA so I don't need to pay VA tax. But it's been almost 3 years and I never got the check sent to me. I had faxed and mailed all. How should I follow up on this with VA department of taxation?

To get the erroneous VA withheld taxes you MUST file a non resident VA return ... there is no other way to do this. You do NOT need to amend the federal return unless you failed to report this income on the original return.
[Edit] ooooops, I thought it happened in 2022 too.
Ok so that's the missing piece here. I actually did submit the non resident VA return in 2020 (for 2017) and last year (for 2020 tax year) but VA so far has never processed it yet or sent me any update. How do I escalate this with VA dept of tax?
