We have attempted for yrs to get a w2 for my deceased ex husband to do his final tax return as I am the one to file his tax returns because our children were minors. The employer I know and I have many paystubs but I believe he is refusing due to undereporting.
You can get a Wage and Income Transcript from the IRS if you only need the tax data for the W-2 - https://www.irs.gov/individuals/get-transcript
The Wage and Income Transcript is available for the current tax year and the past 10 tax years.
For a fee you can get a complete copy of a W-2 from the Social Security Administration - https://faq.ssa.gov/en-us/Topic/article/KA-02501
Options are :
1) get an income transcript
2) report him and use a substitute W-2 form https://www.irs.gov/taxtopics/tc154
3) get one from SS if he ever filed one
If you just need the information from your W-2, but not an actual copy, you can get a Wage and Income Transcript from the IRS for free. This will contain the information from all the W-2s that were sent to the IRS by your employers. However, it does not include the state and local information (boxes 15 - 20). Go to the following link to get a transcript. You want a Wage and Income Transcript, not a Tax Return Transcript.
https://www.irs.gov/individuals/get-transcript
You have to get another copy from the employer or from Social Security

2013 !!!
If the IRS did not send a bill for the unpaid balance due on the unfiled return by now you are not going to get one and it is way too late to file for a refund ... so I would not even try to file this return any longer.
Why should I have to pay another company to receive a legally required document that any company is failing to provide?
The company failing to provide the W2 should be fined and a complaint should be filed with the IRS.
As an employee, I should NOT be charged AT ALL for information my employer is legally required to provide, and in a timely manner.
Sending your customers to another site to be charged is irresponsible.
@jasondspencer There are no other posts from your username in the forum. Your post lacks any context---we have no idea what document you are trying to obtain (a W-2? --- from what tax year? ) or why you believe you are being charged to obtain it. What are you trying to do?
Sorry if you don't like your options on how to get a copy of the W-2 form ... if the employer didn't send one then you CAN turn them in to the IRS for this failure and getting a copy off the income transcript is free.
Employers have until January 31 to mail out W-2s.
While you're waiting, here's some things you can do:
If you haven't received your W-2 by February 14, it's time to take action:
You can get a wage and income transcript from the IRS: It will not show the actual W-2, 1099’s, etc, but will show the income information the IRS received. It will not, however, show your state information. It will only show the federal information.

"if the employer didn't send one then you CAN turn them in to the IRS for this failure and getting a copy off the income transcript is free."
all you did was reiterating my point. it should be free to receive, not a charge as i stated.
So it is impossible to be new to a forum? lol
I was replying to the post stating if we dont receive a W2, we need to go to social security and be charged for a copy.
I was here reviewing posts for exactly this topic. I see everyone is combative and aggressive. awesome forum. not toxic at all.
I am confused ... if you can get it for free what is the charge ?
If you did not get the W-2 form last year by mid Feb then you should have taken action at that time. You still can and you can file without the W-2 form by using the information on the last paycheck stub and filling in form 4852. If you didn't keep your paycheck stubs until you got the W-2 then that is your error.
not interested in the blame game or your attacks. its clear there are no facts in this forum. ill go find answers in helpful places.

IRS wage transcripts *are* free.
Also:
[Paraphrased from IRS rules]
Can you file without having received your W-2? Yes, but only if you have not received it by the end of February, and you have contacted your employer and attempted to obtain it, and you still have not received it then you contact the IRS (see the link below), then if the IRS is not successful in getting your W-2, you can use form 4852 in place of your W-2. But you MUST speak to the IRS before doing so. Otherwise, you cannot file before you receive your W-2.

@jasondspencer No one has attacked you or blamed you. We are giving you as much information as possible about the various ways to get a copy of your W-2, which apparently is what you need. We have given you multiple ways to obtain the information you need. Some of the ways to get your income information are free; some are not.
I need to talk to someone in IRS OFFICE because I failed my taxes on one of my w-2s but St Jude Nursing in New Orleans will not call me or email me back about my W2 and my son W2 and I don't want to get it trouble because I can't claim that W2 I keep calling but it says they not taking calls and hang up on me
