State Taxes

In 2019 I own a home in Louisiana but work and rent in Virginia.

Turbo Tax says to file Married Separate in Virginia and Non-resident in Louisiana.

Seems to be contradictory.

Louisiana requires filing same as in Federal form, which is Married Filing Jointly. What should be done?.

You will not a federal return separately.  You will still file your federal return MFJ and you are only selecting the separate option for the Virginia return.  This does not affect your Louisiana return at all.

File Married Filing Jointly for your federal and Louisiana returns and MFS only in Virginia.

It sounds like the difference in tax on the Virginia return is because the federal filing status has changed.  You do not change your federal filing status.

It depends.

Filing as a nonresident in Louisiana does not affect your status as Married Filing Jointly.

It simply means that you do not reside in Louisiana.

You can still file a joint return in Louisiana while filing as a nonresident.

You need to look at your intent.  If you have set up a domicile in Virginia and no longer reside in Louisiana, you would file as a full year resident in Virginia. If your spouse lives in another state, then you may need to file using the Mixed Residency status.

Please see the attached link for more details as it applies to you.

Thank you for this information.

When I followed the Turbo Tax method of setting up to file Separately in Virginia, the tax bill due to Virginia was over $2400.   Keep in mind that while filling out the Federal as Joint and then doing Virginia - just before TT told me to stop processing there and instead go to File Separately instructions, my Virginia tax bill was a $500 refund.

So, now TT won't move forward to the next screens to complete my Virginia return while selecting Jointly on the Federal return.  Following instructions to file Federal Separately allows TT to proceed to the Virginia return but will cost me $2400 which doesn't seem logical, nor appropriate.

Have I done something wrong?  How do I go about completing the Virginia tax filing while Jointly filing?

Thanks again, this addresses the statements about Louisiana.  When reading the paper instructions for filing in Louisiana, our new home state, their words are clear that filing in Louisiana requires the same filing status as was done on the Federal level.  That's what I was referring to originally.  While using Turbo Tax, I was filing Jointly at Federal level and the question from TT was to be answered as either all year resident of Virginia or not or neither (just income from Virginia).  So choosing all year Virginia = $2400 tax bill, choosing not all year Virginia = $500 tax refund.  Makes sense except TT doesn't allow proceeding beyond the screen that says essentially, we think you should file Separately.  There is no option to move forward.  Any idea what to do?

It depends.

As this is a public forum, we cannot see your return.

But when you entered your information for your federal return, you would have been asked if you want to prepare your state return.  Your answer here would help determine if you have completed and filed your state return.

You can check by logging back into TurboTax.  You can see what tax returns you have filed by following the instructions in the link below.

Obtaining a copy of tax returns filed this year

Once you open the PDF file, you can open it to see what returns were prepared.

If you do not see your state return, do the following to prepare it.

  1. Sign in to TurboTax.
  2. You should be able to see Your Tax Returns & documents
  3. Select show here.
  4. Select 2019
  5. Select Add a state

This will allow you to add your state return.  Once you add your state, follow the prompts to complete your state return.

You will then be able to run a review of your state return and proceed to electronically file your state return.
