Hello team, I entered the U.S. in August 2019 on an F-1 visa. I was exempt from the Substantial Presence Test and FICA taxes for my first 5 calendar years (2019–2023). Beginning January 1, 2024, I became a resident alien for U.S. tax purposes under the Substantial Presence Test. For tax year 2024: I correctly filed Form 1040 (not 1040-NR) My employer issued a W-2, but Social Security and Medicare taxes were NOT withheld (Boxes 3–6 are zero) This appears to be a payroll error where the employer continued F-1 FICA exemption incorrectly I understand that FICA taxes cannot be paid or corrected on Form 1040 or Form 1040-X. My questions are: My employer told, they cant correct 2024 W-2, but to avoid any future issues with IRS, I'm looking to resolve this issue . I'm seeking properly resolve and report the missing employee portion of FICA for 2024. What form is needed here and I used TURBOTAX software for 2024 tax filing returns . Any leads are appreciated. Thank you !!!

No, you do not use a W-2 "instead" of a SSA1099. If you have W-2's for those tax years AND you were also receiving Social Security benefits for those years, ALL of your income for each tax year has to be included on your 2022 and 2023 tax returns. So include your W-2's and your SSA1099----and any other income you received.
Get your missing SSA1099's from Social Security.
HOW TO GET SSA-1099
If you cannot find your SSA1099,you can get one from your nearest Social Security office, or there is a way to go on the Social Security website and request one. Go to www.ssa.gov You have to create an account with a user name and password.
https://www.ssa.gov/myaccount/replacement-SSA-1099.html
https://www.ssa.gov/onlineservices/
https://www.ssa.gov/myaccount/
Go to Federal> Wages & Income>>Retirement Plans and Social Security (SSA1099 and 1099RRB) to enter your SSA1099.
You have to get your 2022 tax return filed no later than April 15 or you will forfeit any refund shown on the form.
You cannot change the tax year. The current online program is for 2025 only. Only a 2025 return can be prepared online and only a 2025 return can be e-filed.
Online preparation and e-filing for 2022, 2023, and 2024 is permanently closed.
Note: The desktop software you need to prepare the prior year return must be installed/downloaded to a full PC or Mac. It cannot be used on a mobile device.
To file a return for a prior tax year
If you need to prepare a return for 2022, 2023, or 2024 you can purchase and download desktop software to do it, then print, sign, and mail the return(s)
https://turbotax.intuit.com/personal-taxes/past-years-products/
You may also want to explore purchasing the software from various retailers such as Amazon, Costco, Best Buy, Walmart, Sam’s, etc.
Remember to prepare your state return as well—if you live in a state that has a state income tax.

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. Use a mailing service that will track it, such as certified mail so you will know the IRS/state received the return.
Federal and state returns must be in separate envelopes and they are mailed to different addresses. Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.

Social Security benefits reported on a Form SSA-1099 can only be entered in the Social Security section of the tax return.
W-2 income can only be reported in the W-2 section of the tax return.

For 2026 the maximum someone over age 50 can contribute is $8600. Your confusion is that there is no income limit to be able to contribute.

Yes, you can contribute and withdraw in the same year. But your deduction is limited to $10,000 a year for joint filers.

I live in Michigan, my husband works for a Michigan company, but worked at an Indiana job site for a few months. We did not know there was a county tax there, and his employer did not take it out of his check. I know there is a Michigan credit for paying an out of state local tax, but can we claim it if it is paid with the Indiana return? If not can we claim it next year?

We did not setup an 529 for our kids, we should have done it earlier. Right now, we know our college expense would be 40k ish annually. Our plan is to contribute 20k into a 529 plan in year 2026, and then withdraw 20k for college expense within 2026. Can I take a tax deduction in for state and city taxes? Because in NYC that would be around 10%. That would be 20k x .1 = 2k in savings.

If tax was withheld from your unemployment benefits, you could file for a refund if you are under the filing threshold. But...you cannot use the Free Edition to enter a 1099G for unemployment. You need to use a paid version -- Deluxe -- which might wash out a chunk or even all of your refund.
Or—-Use this IRS site for other ways to file for free. There are 8 free software versions available from the IRS Free File site
