Its been a year. I’ve exhausted every option possible. Its kind of hard when the IRS turns on their high call volume automatically and can’t get through. I only want answers as to how I can bring a case against the IRS

As for the stimulus ... if you don't get either of them by 1/27 when the efiling season is supposed to open then you can apply for both of them on your 2020 return. 

 

As for the delayed 2019 refund ... to "sue" the IRS requires you to employ a tax attorney but that should be the last resort. 

 

Try  calling to check the status of your refund at the IRS website.

You should then be transferred to an agent, but there is likely to be a long wait.

I just needed to know how to go about this. I don’t need to know how to call the IRS and check the website. After a years wait I’m pretty sure you know I’ve exhausted all options to try to get to the bottom of this.

Google   "tax attorney near me" to see who is in your area and then start calling until you get one who will see you.

Soooo now when you call the IRS it says (literally as soon as they pick up) “Due to high call volume...” and disconnects. Everybody is calling about their stimulus payments which is making it extremely hard for us who are still dealing with refund issues.

Sooo you have given up on the high priced attorney already ?    Did you try the free taxpayer advocate service?  

 

 

And are you sure you filed ?

 

Did you mail your return or e-file?

 

If you mailed it:

The IRS has been working  through millions of mailed returns that have been piling up in trailers during the pandemic.  All you can do is watch the IRS refund site to see when your return makes it to the surface and goes into processing. Sorry.

 

Per the IRS website IRS Operations During COVID-19: Mission-critical functions continue:

Processing Delays for Paper Tax Returns: Taxpayers should file electronically through their tax preparer, tax software provider, or IRS Free File

We’re experiencing delays in processing paper tax returns due to limited staffing. If you already filed a paper return, we will process it in the order we received it.

Do not file a second tax return or contact the IRS about the status of your return.

 

If  you mail a tax return (or a payment) to the IRS, it is a good idea to use a mailing service that will track it like UPS or certified mail so you will know it was received.

 

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. 

 

TurboTax will not know anything about your mailed return, and will continue to show “Ready to Mail” on your account.  TurboTax will not know that you put your tax return in an envelope and took it to a mailbox.  TurboTax does not get updates on mailed  (or e-filed) returns.

 

When the IRS finally opens its mail and begins to process mailed returns you can check the status on the IRS site. https://www.irs.gov/refunds

 

State returns have to be mailed to the state.

Did you e-file?  Did you click a big orange button that said “Transmit my returns now?”

 

When you e-file your federal return you will receive two emails from TurboTax.  The first one will say that your return was submitted.  The second email will tell you if your federal return was accepted or rejected.  If you e-filed a state return, there will be a third email to tell you if the state accepted or rejected your state return.

 

First, check your e-file status to see if your return was accepted:

  Or does your account say “Ready to Mail?”

 

Note: If it says “Ready to Mail” or “Printed” that means YOU have to mail it yourself.  TurboTax does not mail your tax return for you.

 

 

If your e-file was accepted:

 

To check on regular tax refund status via automated phone, call 800-829-1954. (This line has no information on Economic Impact Payments.)

TurboTax gives you an estimated date for receiving your refund based on a 21 day average from your date of acceptance, but it can take longer.  Many refunds are taking longer during the pandemic. 

 

Once your federal return has been accepted by the IRS, only the IRS has any control. TurboTax does not receive any updates from the IRS. Your ONLY source of information about your refund now is the IRS.

You need your filing status, your Social Security number and the exact amount  (line 20 of your Form 1040) of your federal refund to track your Federal refund:

If you chose to have your TurboTax fees deducted from your federal refund, that will take some extra time, while the third party bank handles the refund processing.

And this is why I would rather not get replies from people like you. Yall sit on here all day being sarcastic with people. I actually decided to try once more and got no where. So yes now I will locate a tax attorney.

@dfg5133 You need to check to see if your return really was filed----did you verify that your e-file was accepted?  If it was not accepted then you need to print, sign and mail your 2019 return now.

 

As for the stimulus you did not receive---that can be remedied by filing a 2020 return and using the recovery rebate credit.

 

The stimulus check is an advance on a credit you can receive on your 2020 tax return.  If something went wrong or you did not get the stimulus check this year, you can get it when you file your 2020 return in early 2021—if you are eligible.It will end up on line 30 of your 2020 Form 1040.

We know that the IRS is already revising the 2020 Form 1040 to include the 2nd stimulus, but that change will entail a lot of re-programing at the IRS and for the tax software programs.  It may be at least a month — or longer— before the forms are changed.  Do NOT be in a hurry to file your 2020 tax return until more is known. Give some extra time to the IRS and the software programmers so that the software can handle the new 2nd stimulus, so that you can get it all by filing ONE time. You will need to visit the recovery rebate section AFTER the form and software revisions are complete in order to do this correctly. It is never a good idea to file too early; filing your 2020 return too soon may result in a lot of extra confusion that can be avoided if you wait and file a little later.
