My wife has been a citizen for her entire life. I do not want to treat her as a resident on my tax form. I want her to be treated as the citizen that she is.
She is not a "Nonresident Alien or Dual-Status Alien".
Do I answer yes or no to this question?
This question comes up if a box is checked in the My Info that indicates a spouse is a nonresident. Please return to the My Info section, make note of your spouse's Social Security number, delete her and re-enter.

So, how should I answer this? My wife is a lifelong citizen and a resident. If I click yes, I am saying she is an "Alien" who resides in the U.S. If I click no, I am saying that she is an "Alien" who does not reside in the U.S.

That is not the case. I didn't even have an opportunity to check any boxes before this screen appeared.
If you are going on last year's return, I can show you that she was entered correctly as "none of the above".
Please delete her and re-add her information to clear this error.

Went to the personal info page for wife, nonresident alien or dual-status alien box was not checked, my guess is since this is a new box that the value was null, I had to check and then uncheck the box, and then click through to the federal review, that fixed the issue for me.
I am disappointed that TurboTax still hasn't fixed the issue. This posting was a month ago, and I've found several other, similar postings. I ran into the same problem this morning. The question about treating Nonresident Alien or Dual-Status Alien spouse as U.S. Resident, appeared BEFORE I have entered or verified any information about my spouse. It is impossible to answer correctly before other questions, shouldn't have appeared at all, given our situation, and it is alarming in the current context of anti-immigrant rhetoric in our country.

As others have suggested, we recommend deleting and reentering the spouse information if you are getting follow-up questions suggesting that your spouse was identified as an alien.

I had same problem. I am 100 percent certain I never checked that box and the question stayed even with box unchecked. It is a bug that Turbotax needs to fix.
If I plan to chose non-resident alien spouse as "treat your nonresident spouse as a resident" for year 2024. Can I do e-file via turbotax or not?
I saw this too yesterday. I am the one filling out TurboTax for me and my husband. He does NOT have a Spanish name, but is of Spanish heritage. However, the "IRS" language question took me to the same screen and had selected ME as a resident alien! I am angry over this and being born and raised in the US, there is absolutely NO reason that TurboTax should be automatically checking off the box(es) regarding the spouse. After using TT for decades, I am done. I will be moving our returns elsewhere. It makes me wonder what else is being checked off automatically and reported incorrectly by TT. I am done.
It depends. If you are treating your Non-Resident Alien spouse as a resident and they already have an ITIN, then yes, you should be able to e-file your return for 2024.
If they do not have an ITIN, then no, you would not be able to e-file as those returns have to be mailed along with the W7 application for an ITIN. If this is the case, you will need to print and mail your return along with the W-7 and any other required documents to

This is an error with Turbo Tax. It skipped the review page and then asked about my husband’s alien residency. I went back to review the page mentioned here, and the box was not checked. My husband was adopted from Vietnam at the war’s ending as an infant, and is a US Citizen. The fact that this is the first time this has come up on Turbo Tax after years of using it is unsettling considering the current political climate. Please look into fixing it. There are enough people experiencing this issue to warrant a review.
Just yesterday, we had this question pop up out of no where so TT has apparently still decided not to fix this issue. It is a little troubling that they seem to imply that we all have "accidentally" hit a button that we shouldn't have. We did not even get a chance to click anything before this question came up so it is definitely a bug in the software. I also notice that many people on here commenting have hispanic sounding surnames, which is our case as well. Given the current political climate, can you please fix this issue Turbo Tax? It's not us, it's YOU.
