My mom claimed me as a dependent on her 2020 taxes. I am almost 40 and as a result she has received all of the tax and stimulus breaks without my consent. what do I do?

I can't efile my taxes without selecting that she claimed me. I don't want to select that because I didn't give her permission to. Is my only option mailing my return in?

If your mother can claim you she does not need your permission.    The rule is if you CAN be claimed as a dependent then you have to say on your own tax return that you can be claimed as a dependent.   So....do you fit the criteria to be a qualifying child or qualifying relative?   If so, then you must mark in My Info that you can be claimed.   And....to set the record straight, parents did not receive the first or second stimulus payments for dependent children who were older than 16 at the end of 2020----so if you are older than 16 your mother did not get stimulus checks for you.   The only one she could get if you can be claimed is the third check because the tax law changed to allow a person who claimed an adult dependent to get the $1400 check.  

 

Here are the rules----are you a qualifying child or qualifying relative:

 

WHO CAN I CLAIM AS A DEPENDENT?

 

You can claim a child, relative, friend, fiance (etc.) as a dependent on your 2020 taxes as long as they meet the following requirements:

Qualifying child

•They are related to you.

•They cannot be claimed as a dependent by someone else.

•They are a U.S. citizen, resident alien, national, or a Canadian or   Mexican resident.

•They are not filing a joint return with their spouse.

•They are under the age of 19 (or 24 for full-time students).

    • No age limit for permanently and totally disabled children

        They live with you for more than half the year (exceptions apply).

Qualifying relative

•They don't have to be related to you (despite the name).

•They cannot be claimed as a dependent by someone else.

•They are a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.

•They are not filing a joint return with their spouse.

They lived with you the entire year.

•They made less than $4300  (not counting Social Security)

•You provided more than half of their financial support. More info

If in fact you do not fit the criteria to be claimed as a dependent then you will have to print, sign and mail your return that says you cannot be claimed.   You will not be able to e-file since your Social Security number has already been put into the system.  Even if your parent files an amended return that will not enable you to e-file.   You can only file by mail if you are saying you cannot be claimed.

 

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s.  Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

Federal and state returns must be in separate envelopes and they are mailed to different addresses.  Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.

If you CANNOT be claimed, then your mom will need to amend her return, but do not wait for her to do that.

 

Make sure you go through the recovery rebate credit section to get the stimulus checks.

 

The stimulus check is an advance on a credit you can receive on your 2020 tax return.  If something went wrong or you did not get the stimulus check in 2020, you can get it when you file your 2020 return in early 2021

The Recovery Rebate Credit will be found in the FEDERAL REVIEW section. ( you should see "Let's make sure you got the right stimulus amount”)  If you are eligible it will end up on line 30 of your 2020 Form 1040.

 

Make sure that you enter ALL of the stimulus money received for the 1st and 2nd stimulus for yourself, your spouse and your children.
