My son's father has been claiming my son for the past nine years now. But for the past year and a half almost two years now he has stopped providing for our son. My son is now ten years old. He was allowed to claim him as long as he provided for his son financially and consistently. However, this has stopped unfortunately. He told me that he will continue to claim him whether he is providing for him or not because he has been claiming him on his taxes for years now. Also since i am the only parent that is now supporting him by myself I wanted to claim my son for the very first time this year.

No, you cannot stop someone from claiming a dependent.

But, If someone else claimed your child inappropriately, and if they file first, your return will be rejected if e-filed. You would then need to file a return on paper, claiming the child as  appropriate. The IRS will process your return and send you your refund, in the normal time. Shortly (up to a year) thereafter, you'll receive a letter from the IRS, stating that your child was claimed on another return. It will tell you that if you made a mistake to file an amended return and if you didn't make a mistake to do nothing. The other party will get the same letter you did. If one of you doesn't file an amended return, unclaiming the child, the next letter, from the IRS, will require you to provide proof. Be sure to reply in a timely manner.

Winner gets the tax benefits; loser gets to pay the IRS back with penalties and interest.  The custodial parent almost always wins. The non-custodial parent can only claim the child as a dependent if the custodial parent gives permission (on form 8332) or if it's spelled out in a pre 2009 divorce decree, without conditions, such as child support.

The fact that he has claimed the child, for the past few years, is not relevant.

@Lateshia85 Did you read the answer in the thread above your question?  You cannot put a "stop" on anyone from claiming your child.  If someone already claimed your child, and your tax return is being rejected when you try to e-file, then you have to print, sign and mail your own tax return that claimed the child.  Then the IRS will sort out who could legally claim the child.

It may not work but you can file a form 14039 and to get an efile PIN for the child ...

Someone else claimed my dependent and my return was rejected

If someone else claimed your dependent already, then your e-filed return will be rejected.  Print, sign and mail your own return which claims your dependent.  Mailed returns are processed differently by the IRS.  It will take some time (maybe even up to a year) but eventually the IRS will contact both parties and sort out who could rightfully claim the dependent.  The person who wrongfully claimed the dependent will face repayment of refund $, plus penalties.

 

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s.  Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

Before the corona virus.my son social security was stolen and filed.i need help putting a block on his card.that person want even give me my son card back.

If the Social Security Card was lost or stolen, you must contact the Social Security Administration and the IRS.

What is a SS PIN # ?   Do you mean they have an IP PIN from the IRS ?   If so you must wait until they mail out the new one for the 2020 tax year which usually is mailed in January.  

 

The IP PIN entry is not in the FILE section.  It is in a completely different section of the TurboTax interview. Here are 3 ways to get to the right place to enter the IP PIN.  You only need to use one method.   You can choose which method works for you the best.

 

  • With your return open, click in the top right corner on SEARCH.
  • Enter the term IP PIN without quotes, ignore the dropdown menu while entering it, and instead click the magnifying glass on that same line.
  • Then click on Jump to IP PIN.

Or here's a second way:

  • With your return open, click in the left menu column on TAX TOOLS, then choose TOOLS.
  • In the Tools window choose TOPIC SEARCH.
  • Enter the term IP PIN without quotes.
  • In the selection list highlight IP PIN and click GO.

Or here's a third navigation method:

  • With your return open, in the left menu column, click Federal.
  • Then at the top of the screen choose  Other Tax Situations
  • After that, if necessary, click on "See all uncommon tax situations" to see all the topics in that section.
  • In the "Uncommon tax situations" list, scroll down to Other Return Info, and expand to see the subtopics, one of which is Identity Protection PIN.

I’m sorry but that is not correct what others have said that you can’t put a PIN on your dependents ssn. You most definitely can! Pull the form off the IRS website and after doing so if someone tries to do it again they will have to know that PIN for the return to be accepted by the IRS. Your best bet in all honesty is modify your current custody order so not only will he not get the CTC or the EIC but he will as well be in contempt of a court order.
