SSI benefits can become an issue in regards to the support test. I am assuming that this person is an adult and they are not related to you. If this is the case, they would need to qualify as a qualifying relative dependent. The requirements are as follows:

The support test considers any of this person's (including social security) money that is used for their food, shelter, clothing, transportation, entertainment, and medical expenses as personally provided support. Any of their money that is not used for support (kept in the bank) is not counted as support provided by the individual. Therefore, you must pay for more for their support from your funds than they pay from their funds. Fill out worksheet 2 on page 16 of IRS Publication 501 to make sure you meet this requirement.

Yes, because SSI income is exempt from tax, it does not count toward gross income.  You can claim your mother as a dependent because she passes the test for a qualifying relative per Table 5 from IRS Publication 501 at this link.

My girlfriend is on SSI and she was awarded benefits in October 2021. I've paid all her expenses but i dont want to claim her if it'll mess her benefits up for her. Please let me know.

You have to ask ssi.  And you can only claim her if she lived with you the whole year and had less than $4,300 income (ssi doesn't count).

Survivor benefits are not affected by you being claimed as a dependent on someone else's return.

To claim someone who is not a child they must meet the requirements under the Qualifying Relative rules.

 

To be a Qualifying Relative -

1. The person cannot be your qualifying child or the qualifying child of any other taxpayer. A child is not the qualifying child of any other taxpayer if the child's parent (or any other person for whom the child is defined as a qualifying child) is not required to file an income tax return or files an income tax return only to get a refund on income tax withheld.
2. The person either (a) must be related to you or (b) must live with you all year as a member of your household.
3. The person's gross income for the year must be less than $5,050 (social security does not count) in 2024
4. You must provide more than half of the person's total support for the year.
5. The person must be a U.S. citizen or a U.S., Canada, or Mexico resident for some part of the year.
6. The person must not file a joint return with their spouse with the following exception -
You can claim a person as a dependent who files a joint return if that person and that person’s spouse file the joint return only to claim a refund of income tax withheld or estimated tax paid.

Yes, if his only income is SSI, and he meets the criteria of a qualifying relative or if he is  young enough to be a qualifying child, then you would be able to claim him as a dependent. 

 

 To claim someone as a Qualifying Relative, they must be:

  • Your child ( including step children, adoptive children and foster children) or a descendent of them
  • Your sibling (including half siblings) or a child of your sibling or a sibling-in-law
  • Your parent or grandparents, including step parents and in laws
  • Any other person that lived with you for the entire tax year
  • Not a qualifying child of another taxpayer
  • Someone that you provided over half of their support for during the tax year
  • Has less than $5,050 in income (not counting social security)

The following criteria must be met to claim someone as a qualifying child:

  • Your child (including adopted and foster children), your sibling, or a descendent of any of them.
  • Age 18 or younger at the end of the tax year OR under 24 (and younger than you and your spouse) if they are a full-time student
  • Lived with you for more than 6 months during the tax year
  • They did not provide more than half of their own support (social security does not count)
  • They did not file a joint return, unless it was to claim a refund
