Are truck drivers exempted from Oregon Taxes?

If you are a nonresident of Oregon, have assigned duties there regularly and in at least one other state; you have to meet the requirements below for them to not tax your wages.

You will find examples of the types of workers that would be exempt here (Example 4 may be closest to regular truck driver situations, but review them all) http://library.state.or.us/repository/2011/201112071113563/Dec2009.pdf

To qualify, you must work for:

• An interstate railroad, or

• An interstate motor carrier, or

• An interstate motor private carrier.

In addition, you must:

• Be a nonresident of Oregon, and

• Have regularly assigned duties in more than one state. This means you perform duties in each state on a regular basis. Duties you perform on an "on-call" or "as-needed" basis or on a sporadic or intermittent basis during the year are not considered "regularly assigned duties," and

• Be subject to the jurisdiction of the U.S. Secretary of Transportation.

My husband is OTR driver, pulls a step deck 53" trailer. Being the company he pulls for is not from Oregon, he had to buy a permit for the load. The Oregon State Tax was $119.90. Just FYI, hope this helped. This is all deductible expenses. Like it says above, research it, every situation is different.

The taxation of an interstate truck driver depends on whether they are an Oregon resident. Oregon residents are taxed on income earned everywhere.

If the truck driver does not live in Oregon but has “regularly assigned duties in more than one state,” you can file a nonresident Oregon return and claim a refund on taxes withheld.
