Good morning, Last year I filed my taxes through Sprintax as a non-resident. This year I wanted to do the same thing, but it said I am now a resident. I came to the US in August 2023 on my J1 research scholar visa from the Netherlands. Could you help me and tell me if I'm now a resident? Are there any tax-treaties between the Netherlands and US that I should know of/can benefit from? Which forms should I now file? Can I file my taxes through turbotax? Thank you so much! Best, Stella

I am assuming you are talking about the Overtime Deduction.
To calculate your overtime deduction you would take your overtime pay per hour minus your base pay per hour and multiple that by your total overtime hours. If your employer lists your total overtime you can divide that by 3 to get the OT Premium amount if your OT is paid at time and a half. If you are paid double time you would divide it by 4. Only the .5 amount is deductible.
So if you work 300 hours of OT and earn $30 per hour for your regular pay and $45 per hour for overtime, you would multiple $15 (45-30) by the 300 hours for a total of $4,500.
If you do not want to do the math and you know the full amount you were paid in OT, based on your last paystub, then you can enter the full amount that is showing on your last paystub and have TurboTax calculate it in a later step.
To qualify the following must apply:
You must be a non-exempt employee eligible for Overtime under the federal Fair Labor Standards Act
The Overtime must be on hours worked OVER 40 hours. (if you live in a state where OT pay is required after 8 hours, this does not apply)
Overtime must be paid at more than your regular hourly rate.
Your filing status cannot be Married Filing Separately
Your income must be less than $150,000 if you are single or $300,000 if Married Filing Jointly.

Actually my problem was that Turbo never asked me when it saw I was getting a refund, how I wanted it. Auto deposit or mailed check. I had to go into the actual forms and check the box for deposit.

There is an additional box after you enter your W-2 and hit continue, but you cannot deduct the full amount of your overtime so your W-2 could potentially be correct. If your overtime on yoru paystub included double time or overtime for hours over 8 hours in a day or holiday pay or shift differential, then not all of this would count for the No Tax On Overtime Deduction.
For the no tax on overtime deduction, you can only deduct the .5 premium amount you were paid for hours over 40 hours. So if you were paid $20 per hour, and you received double time on some days, you would only be able to deduct $10 per hour of that overtime, not the full extra $20 per hour. If you are paid time and a half then you would you would still only be able to deduct the .5 premium which would still be the $10 per hour.
If your number is definitely wrong, you can change it when you continue through. After you finish entering your W-2 you will be asked additional questions on your OT. Here is where you would make the changes. Before making any changes you should contact your employer to determine how they came up with the number they put in box 14. If they are only including the .5 premium on hours over 40 hours, this would be correct. If it is not correct, then you can request a correct W-2 from them, but if they do not send one, you can make the adjustment after you enter your W-2 in the additional questions for overtime section.
