I spoke to the irs and they said that you can file and amend and get the standard deduction but it won't help with the credits. What would happen if I originally filed head of household and got chikd tax credits and I amend it filing jointly with the itin. Will the irs send me a bill for the child tax credits in that case? Can you explain where you get all this info also from?
When you Amend to change your Filing Status from Head of Household to Married Filing Jointly, you may not have to pay any of your Refund back. You should get Child Tax Credits either way.
The Amended Form 1040X will show if there is a Balance Due from your original filing to the new filing.

Thank you. We are submitting the 2023 return with the w-7 for the itin and since our kids and I are US citizens and my wife is getting an itin we would like to file and amend past years. Have not filed 2022 return at all. 2020 I filed head of household and 2021 single even though we were married but didn't know how to file because we did not have itin. For 2020 we got stimulus payments when I filed head of household. For 2021 we got chikd tax credits when I filed single. Can I file 2022 return jointly and claim child tax credits as well as amend 2020-2021 return to add income and also claim child tax credits jointly which would increase the credit? Would they accept it? What is the source whether you can or can not
You can amend past years to file jointly and most items will be accepted. However, stimulus payments will not be made based on having an ITIN.
if your kids were not previously on the tax return, you can add them when amended and credits will be issued as long as their social security numbers were issued before the due date of the return (including extensions). If they were already on the return, then the child tax credits won't likely change due to changing the filing status to married filing jointly.

as far I know child tax credit is only allowed to claim from year when you applied ITIN for child along with tax return.
you cant amend prior year taxes for child tax credit with new ITIN.
but still you can amend as status MFJ with spouse ITIN. upto 3 prior years taxes you can amend.

So can I just file married jointly to claim CTC and make a note on tax return that I am OK of they give me a CTC likenhwad of household or do i have to file head of household to get it? Does the amount of CTC depend on filing status or just income? Is it more if you file jointly? Is it too late to amend 2020 and or 2021 for CTC since I need to add income anyway and I want to know if the credits are still available even if I file head of household
it doesnt matter what status you filing with MFJ/head or single.
but to claim kids benefits it depends when you got SSN or ITIN for kids. ITIN received later/current cant be used for prior year CTC.
SSN if received in earlier year you can still use to get child tax benefits.
2020 - not sure.. check IRS terms.

You cannot claim the Child Tax Credit with an ITIN. You can only claim the $500 Non-Refundable Other Dependent Credit. You can not go back and claim the CTC for years prior. You can only claim the CTC for the years that the child had a SSN before the filing deadline. So, if they just received the SSN this year, you would not be able to claim the CTC for any year before 2023. You can not backdate qualifications. You must qualify during that tax filing period in order to claim the credit.
If you are married and your spouse lived with you at all during the last 6 months of the year, you cannot file as Head of Household. You can only file as married filing jointly or married filing separately.
So if our kids always had social security numbers and i get my wife an itin this year then can I file jointly and claim child tax credits for 2020-2022 once we have the itin?
No, you cannot back date your wife's return since she didn't have it during that time.
