Same here. My (now ex) husband claimed me as a dependent in 2018 and 2019, long after he'd abandoned me and our children for another woman. He did absolutely nothing for me in 2018 and 2019, besides leave me with a mountain of bills. He was too busy taking care of this other woman and her kids. It was like our 18 year marriage never even existed to him. He used the tax return to file for divorce.

If someone else claimed you are their return, you can still claim yourself, but you will need to print and mail your return. You are no longer eligible to efile. The IRS will review each return and contact the taxpayers involved to verify and make a determination on dependency.

Repeating a previous reply in this thread; which appears to apply to you:

 

At this point, you have two choices:

1. Don't claim yourself (check the box on form 1040 that says somebody can claim you) and you can e-file.

2. File a mail-in paper return. The IRS will send you your refund and  sort it out later.  See below, for details.

 

As others have suggested, the 2nd issue here, is do you really qualify to claim yourself. Your relative does not need your permission to claim you.  He only needs to meet the rules.

A 3rd issue is what are you trying to get by claiming yourself. With the tax law change, effective 2018, most dependents will get the same refund whether they claim themselves or not. The personal exemption has been eliminated and the standard deduction increased. 

If it's the stimulus money, you're after.  That can wait til next year. The paper filing will delay it several months anyway. In essence, the stimulus check acts as an advance of your 2020 income tax refund. This means when you prepare your 2020 income tax return, next year, there will be a line, on the forms, to claim it, if you didn't get it in this year.

If someone else claimed you, as a dependent,  inappropriately, and if they file first, your return will be rejected if e-filed. You would then need to file a return on paper, claiming yourself, if appropriate. The IRS will process your return and send you your refund, in the normal time. Shortly (up to a year) thereafter, you’ll receive a letter from the IRS, stating that your exemption was claimed on another return. It will tell you that if you made a mistake to file an amended return and if you didn't make a mistake to do nothing. The other party will get the same letter you did. If one of you doesn't file an amended return, unclaiming the exemption, the next letter, from the IRS, will require you to provide proof. Be sure to reply in a timely manner.

Winner gets the tax benefits; loser gets to pay the IRS back with penalties and interest.

You will have to print and mail your tax return.  It cannot be e-filed since the IRS has already received a tax return with your Social Security number on a tax return.

All you can do is mail in a paper return if the efiling is being rejected because your SS# has already been used ...

 

  

Start by double-checking your Social Security number in TurboTax. If it's wrong, correct it and then resubmit your return. If you entered it correctly then...

 

Next check to see if you accidentally filed yourself by mistake earlier (or you already filed a stimulus registration return )  :

Check Your E-File Status on this Secure TurboTax website
https://turbotax.intuit.com/efile/efile_status_lookup.jsp
- It will show the date you transmitted your return and if it was accepted or rejected.  
- Both your Federal and State will be listed separately if you filed both.
- It will tell you when you E-filed
- The electronic filing date

 

Then if it wasn't you: 

Then it's likely that another taxpayer, inadvertently or otherwise, filed their return using your Social Security number.

 

You won't be able to fix this rejection; you'll need to file a paper return and attach a copy of the IRS form 14039 http://www.irs.gov/pub/irs-pdf/f14039.pdf

I took all the steps when my identity was stolen.still haven't heard anything.the chick that stole everything is still causing me issue

All you can do is mail in the return for now ... then file the form 14039 so the IRS will issue you an IP PIN for the future tax returns so your SS# cannot be filed without it.
