In order to claim the credit, you would have had to be 18 for the entire year. So if you turned 18 in January, you would not meet the full year requirement.   If you are under 18, you would qualify if you were required to file  a federal return or if you filed one to obtain a refund.

My son was over 18 all year and Turbo Tax is saying he doesn't qualify (he was also not incarcerated) for the sales tax credit. My daughter who is 16 received the credit according to Turbo Tax. Something doesn't seem right.

Did your son  not qualify for the sales tax credit?  Did your son have an income tax liability?  The qualifications for the credit are:

 

  • File a 2022 DR 0104 by April 18, 2023, if you:
    • were at least 18 years old when the tax year began,
    • do not have a Colorado income tax liability, and
    • are not claiming a refund of wage withholding.

This Colorado Department of Revenue website states:

 

A TABOR income tax rate reduction results in either a larger refund, if the taxpayer over-withheld, or a smaller bill, if the taxpayer did not withhold enough or make enough estimated tax payments that year. The refund amount is different for each taxpayer, based on their unique income tax situation.

 

Colorado residents under the age of 18 but are required to file a Federal 1040 tax return are eligible for the benefit.

 

A dependent of another taxpayer is required to file his or her own tax return if:

 

  • Your earned income (money you made by working) exceeds $12,950,
  • Your unearned income (interest, dividends, capital gains, etc.) exceeds $1,100,
  • Your business or self-employment net income (gross minus expenses) is at least $400,
  • Your gross income (earned plus unearned) exceeds the larger of $1,100 or your earned income (up to $12,600) plus $350.

He qualified based on those criteria. I may just file a paper return vs Turbo Tax since to get the credit and it is a simple return.

Similar to others in this post, my single son meets the qualifications for the CO state sales tax refund - i.e. full time resident, over 18 for the entire 2022, filing by April 18 and not incarcerated.   Here is a link to the CO tax language (see page 8).

After the TT interview questions, TT responds that he does not qualify (without a reason) and TT does not add the state sales tax refund on line 33.    I switched to "forms" and overrode the line 33 entry, adding $153.    The override entry does not trigger an error during the review and check process.    Seems like there is a bust in the interview (as if it ignores the response to the incarceration question).

No. I strongly advise against overriding the entry and adding $153. Overriding an entry will VOID your Accuracy Guarantee. Also, an override will cause your CO state return to be rejected.

 

To address the question, I would like to do a Diagnostic. The diagnostic code is used by the TurboTax Agent to view your "scrubbed" copy of your return when you are having certain problems that cannot be resolved.  You, the customer give the agent this code for them to enter.  Your personal information is removed. Here are the steps to get the code:

 

  1. Sign in to their TurboTax account.
  2. Open or continue their return.
  3. In the left panel, Select Tax Tools, and then Tools
  4. In the Tools Center pop-up, select Share my file with Agent
    • They’re notified that all personally identifiable information (PII) is being removed
  5. Tell you the seven-digit token number that appears
  6. Select to close the Tools Center pop-up

 Please add this token number to your post.

I am experiencing exactly the same issue...the sales tax refund is calculated for my 16 year old son but my 18 year old son is determined to be ineligible.  I've scrubbed and compared both returns - they have very similar situations.  I suspect there is a bug in the program that distinguishes something between the age groups incorrectly.

We can try to help if you send us a diagnostic file.  You can send us a “diagnostic” file that has your “numbers” but not your personal information.  If you would like to do this, here are the instructions: 

 

In TurboTax Online, go to the black panel on the left side of your program and select Tax Tools. 

  1. Then select Tools below Tax Tools. 
  2. A window will pop up which says Tools Center.  
  3. On this screen, select Share my file with Agent. 
  4. You will see a message explaining what the diagnostic copy is.  Click okay through this screen and then you will get a Token number. 

In TurboTax CD/Download versions, go to the black panel on the top of your screen and select Online. 

  1. Scroll down to and select Send tax file to Agent. 
  2. You will see a message explaining what the diagnostic copy is.  Click send through this screen and then you will get a Token number. 

Reply to this thread with your Token number. This will allow us to open a copy of your return without seeing any personal information.   

We will then be able to see exactly what you are seeing and we can determine what exactly is going on in your return and provide you with a resolution.

Hi all, My 19-year-old son filed his taxes a few days ago. He meets all the qualifications for the State Sales Tax refund (income and residency requirements.) However, he got to the "have you been incarcerated this year" screen, answered 'no', and the next screen said he didn't qualify. He had no idea why that happened, and proceeded to submit the tax return.

This seems to be a bug in the TurboTax software. Now that he has submitted the return, do you have any advice for how to reclaim that refund? Does he need to contact the state directly, or can it be done later through TurboTax? Thank you!

Your son would have to file an amended return to get the credit, assuming he was entitled to it. You should wait until he receives his refund as it is posible the state taxing authorities will correct his return and refund the sales tax, assuming it was reported wrong.

 

You will see an option on your son's homepage in TurboTax to prepare an amended return. @Ksperry

Thanks, Thomas. We'll amend the return when that option is available, and other Experts in this thread have recommended a diagnostic that we can go through to hopefully fix the problem.

Question: is it possible to flag up this issue as a bug, and possibly have the code fixed? I would assume that there are many others who ran through the interview questions and were told they didn't qualify, when in fact they do.

We cannot recreate this issue.  The only way we can work to improve the software is with examples of the issue.  You can send us a “diagnostic” file that has your “numbers” but not your personal information.  If you would like to do this, here are the instructions:
