Hello, I am trying to get clarification regarding CA 593 Real estate tax withholding? I am having a hard time interpreting IRC 121 for the extension of a 10-year look back for active-duty military members and partial exclusions due to relocation for employment. It is unclear what option we should select on the 593 (if any at all). Situation - AD military resided in property for 19 months, 12 days (Jan 2020 - Sep 2021) relocated due to military separations (graduate school) and employment (mil spouse/reservist - was on active orders for greater than 90 days before relocation). Rather than selling we decided to convert our residence to a rental as we initially intended to move back to CA from MN but we ultimately decided not to and are now selling. Do we qualify for exemption?

When you say it was fully depreciated, do you mean the S-corporation reimbursed you personally via an Accountable Plan? The S-corporation can't depreciate something it doesn't own, but it can reimburse via an Accountable Plan. Paying off a loan is not a deduction.

@Newlifestarts120608 Your choices for 2025 will be married filing jointly or married filing separately.
If you got married in 2024, you had those same choices for 2024. The only way you could have legitimately used "Head of Household" for 2024 would have been if you and your spouse lived apart for at least the last six months of 2024.
Am I Head of Household?

What is a "qualifying person" for Head of Household?
If you qualify as Head of Household, when you enter your marital status (single or married filing separately) into MyInfo, and then enter your qualifying dependent, TurboTax will offer HOH as your filing status.

Hi community, I am a US Citizen and I got married to a Pakistani girl in 2022. I filed 2023 and 2024 Tax Return as Married Filing Separately as my wife was non resident. She has become a permanent resident in May 2025 and is here in US now. I was told by my CPA that I can amend my 1040 for 2023 and 2024 to change the status from MFS to MFJ to get more refund after my wife comes here and gets SSN. While doing my research, I came across an election that needs to be made in order to treat a non resident spouse as resident for US for tax purposes for amending. My wife is a homemaker and didn't earn anything. The election is 6013(g). Can somebody confirm whether I need to make that election and what are the pros and cons of that election? What else is needed for amendment apart from updated 1040 and 1040-X? Also, are there any consequences or danger of getting audited if I do this? Also, I wanted to confirm whether I can use her SSN that is issued in 2025 for 2023 and 2024 tax returns? Thanks.

You need to start entering some basic Personal Info in 2024 for the side menu to open up. Just continue a little ways into 2024. I had to go though about 12 screens. If you used the Desktop CD/Download program then the only copy is on your computer and not saved or stored online. So you need to make and keep your own backups. Or request a transcript from the IRS https://www.irs.gov/individuals/get-transcript Or get a copy of your return using form 4506 https://www.irs.gov/pub/irs-pdf/f4506.pdf

Has anyone else experienced this, My 2023 tax return was filed early and accepted - My tax refund status has said "sent to bank" for the past 2 years ... I have spoken to TurboTax, My bank, and the IRS a NUMBER of times, each time I am pointed in the direction of TurboTax being the issue. After over a year of phone calls, refund traces with the IRS etc. I found out that TurboTax not only fraudulently charged me for using a tax preparer but that they sent my tax refund to a random bank. I have been unable to get this situation rectified, nor have I received my tax refund. The IRS says my next step is hiring a Lawyer ... If anyone has experienced this or found a way to get their tax refund back from Turbo Tax without a Lawyer I would greatly appreciate the information!

You would have to test it yourself. Generally, you will pay less combined tax by filing one joint return instead of two separate returns. However, if you currently qualify for Earned Income Credit, your husband's earnings could disqualify you. Depending on the type of survivor benefits you receive for your children, you might pay more tax on them if your combined income is high enough. (Unless the income is in the children's name, then it is not taxable unless they earn money and file a return.)
The only real way to know is to prepare test returns in both scenarios.
