What are you trying to do?   Do you mean you paid someone to babysit in your home while you worked?  If so, and you paid the babysitter over $2600 in 2023, you had a "household employee" and are supposed to issue a W-2 to them.   That you think they only watched tv is irrelevant.   They were there taking care of your child.

And....in order for you to get the childcare credit on your tax return, you will need the babysitter's SSN or Tax ID.

If the babysitter cared for your child in her own home, then she has self-employment income and reports it all on her own tax return and pays self-employment tax.  But you still need the SSN or Tax ID.

This was a night emergency person, baby slept 

so the only duties they had was watching the child sleep ... @xmasbaby0  stay calm

in less than 6 months they've been paid over 10k  (hence new user)

I was unaware of household employee/ nanny  info as I've always only done daycare

so I am wondering what I need to file by tomorrow? Bc I did not do a EIN or withhold

If you are asking, how do you claim the Child and Dependent Care Credit since you paid a babysitter to watch your baby, there are certain requirements that you must meet:

  • Must have earned earned income (If you are Married Filing Jointly there are exceptions)
  • You must have paid for caregiving expenses to work or look for work
  • The care you paid for was for a qualifying person
  • You aren't using the Married Filing Separate Filing Status
  • You provide the caregiver's name, address, social security, or taxpayer ID number.

TurboTax will guide you through this credit, determine your eligibility, and calculate the maximum credit allowed.

 

Note: you must get the individual’s SSN to enter on your tax return to claim this credit.

We need to know where the childcare took place. 

 

If it was in your home, you are supposed to issue a W-2 to her.

 

If the childcare took place in the babysitter's home, you do not need to issue any sort of document to her.   But you need her SSN or her Tax ID.   She still needs to report it on her own tax return.  If you enter the amount you paid her on your return, the amount she reports on her own return has to match.  The IRS cross checks that.
