Two family’s one house

So me, my wife, and our 3 kids just moved back in with my mom, dad, brother(17) and sister(4). I have filed Married filing jointly since I have been married, and my dad files H.O.H. With an injured spouse. Everything is split 50/50 between the families. What would be the best way for us to file this year?

You are living with your spouse and your children.  You and your spouse can file a joint tax return, unless you had no income and are being supported by your parents.  Is that the situation?   Or did you have income in 2022?    You say you "just" moved in with your folks----when?   Provide some details and explain what income you and your spouse have had.

And...."He files HOH with injured spouse" makes no sense.  You file injured spouse if you are filing a joint return with a spouse; "injured spouse" helps to protect part of the refund for one of the spouses when the other one owes back tax, child support, etc.

 

Head of Household is used if the taxpayer is living apart from their spouse or if they are unmarried and supporting a qualified dependent.

 

We need to know if your father supported you and/or your family during 2022.   Is he wanting to claim everyone as dependents because you moved in?

So we moved in early August ‘22. I have supported my family on my own as has he. I’m not 100% sure how he files, but I know they do something because my mom owes school debt from before they were married, and that is how he keeps from paying her debt back. We live in TN and the loan is from OR.

@Smcnulty0901 Okay.....forget about the 50-50 stuff... That is just family cost sharing.   If you worked and supported your own spouse and children then just file a joint return.  Let Dad file as he files.  You are sharing an address.  No one has to change how they file their tax returns as a result of the living arrangement.
