If he "Could be claimed as a dependent on someone else's return" he needs to amend his return.  In the meantime if you can claim him as a dependent on your return you will need to print and mail in your return.  I would include a copy of his amendment in your package.

DMark and other repliers...Appreciate your attempts but you are giving an obvious answer to a situation different than the one that I and many others have described.  I filed daughters taxes, checking box that she could be claimed by someone else as a dependent (therefore not entitled to a Personal Exemption).  Earlier I mistakenly said I e-filed her return but I did not, I filed it via paper/mail.  So on her 1040, there is no Personal Exemption taken by her.  The IRS then processed it and her Tax Transcript says she did claim herself for Personal Exemption.  So it is an IRS processing error.

 

I have tried to call the IRS 4 times, go through all the voice prompts only to be told they are too busy, call again another day (that is an unacceptable abomination in itself).  So I have sent the case to the Taxpayer Advocate Service in my state (AR) to see if they might help me.  I cannot amend her return, there is nothing to amend, it was filed correctly in the first place.  If they will not help me, I'm not sure where to turn.

 

I thought about just deleting her from my return as a Dependent but it lowers my Fed refund by $1300+ so I'm not willing to do that.

 

So please everyone, do not tell me that if she did not check the box that she could be claimed by a dependent by someone else, she will have to amend her return and I will have to send mine in via paper.  That is an INCORRECT RESPONSE to this problem which I and many others have.

There is no longer an exemption to claim.  As part of the Tax Cuts and Jobs Act, Exemptions or Allowances are no longer applicable. 

 

My suggestion is claim your daughter and paper file your return.

I have the exact same situation as you...confirmed that my kids' returns were filed correctly (i.e. stating that someone else can claim them as a dependent).  I also attempted to contact the IRS and got a similar reply, "Due to temporary technical difficulties, we cannot answer your call.  Please call back another day."  It sounds like the only solution is to paper file.  Frustrating!

I got this rejection code for my dependents, but they can't have filed because they are all under 5 years old.

 

They  also can't be claimed by anyone else because their biological mother and I are still married and filing together so...

 

What do I do?

Sorry to hear that.  As best I can tell, having spent hours on this, the IRS has a glitch.  And forget about trying to call them, no go due to virus.  Best I can suggest is to call them when they are back to work (better call right as they open) and try to get this remedied.  I still have no resolution on my issue and a $4000 refund on hold due to their screw up.  I mean, out of work, it's not like we could use the $4000 or anything.

TOTALLY NOT APPLICABLE to the situation I (and many others have described in detail).  Do you even read the situation as it is described?  Apparently not.

I have been reject 5 times and my son has not filed his own taxes nor no one else has claimed him. What should I do?

Rejected with code 517?  If so, have to try to get a hold of IRS and ask them why, assuming you claimed the right number of exemptions.  Can't call them (in my experience) so will have to write to them and wait and wait and wait...Sorry.  My tax issue still not fixed either.

Reject code IND 517 tells us that a dependent on the tax return has already been listed on another return. 

 

You will not be able to file your return electronically this year.  

 

You must file your return by mail.

 

Change the filing method to "file by mail", print and sign the return, attach copies of your W-2 and any other forms that show withholding amounts, and mail to the address that prints on the TurboTax sheet that prints with the return.

 

Note that your federal return will be mailed separately form your state return, if you live in a state with income tax. 

 

If you are certain that no one you know could have claimed your child (such as another parent) and that your child didn't file his or her own return you should also file Form 14039 with your return. You can find that form, and more information about it here: When to file Form 14039.

 

The IRS will process your return normally once processing resumes and later in the year they will send letters to all taxpayers who filed a return with the social security number that was duplicated.  Each taxpayer will be asked to provide support for the claim to the dependent. 

 

The IRS will determine which tax return is correct and will adjust the incorrectly filed return.  The adjustment can include additional tax, interest, and penalties.  If credits were claimed to which the taxpayer was not entitled, the taxpayer whose return is corrected can, in some instances, also be barred from taking certain credits for up to ten years.

Thank you for your detailed response but it is not pertinent to my situation.  I filed my daughter's taxes, checking the box "I can be claimed as a Dependent by Someone Else."  She made $2944 from a part time summer job and was a full time student, living with her parents and we paid all of her support.  The IRS processed her return and she got back all withholdings from Fed & State.  BUT for some unknown reason, the IRS ignored the "I can be claimed ..." box I checked and says she claimed herself as a Personal Exemption (verified by getting a copy of her Tax Transcript).

 

Therefore when I filed our taxes and claimed her as a dependent, our taxes were rejected since the IRS says she already claimed herself.

 

I can't Amend her taxes as there is nothing to amend.  Her taxes as originally submitted and as amended are identical.  It appears to me it is a processing error by the IRS but of course you can't get a hold of them due to the pandemic.  Very frustrating especially since I have a $4000 refund being held up due to the IRS's processing error.

It doesn't mean you claimed anyone else, it means another return was filed where someone claimed you, perhaps in error.  The only resolution is to mail the return.  The IRS will later contact anyone else who listed you on the return to sort out the error, and will process your return with the information that you provide them but once a SSN is marked as used in the e-file system for the tax year, another return will not go through.

It may be that it was simply a processing error, however the resolution remains the same, your tax return must be mailed to be processed. There is no workaround for this error. 

 

One a tax ID is "used" in the e-file software system it cannot be used again on another return in the e-file system.  The return must be mailed in.

 

Even if you could talk to the IRS, it wouldn't resolve the issue.  The return must, unfortunately, now be mailed.

Well, I still don't see why you even sent this.... I filed my own taxes back in January and already received them???? So why are you even sending me this
