If a dependent that you are entitled to claim has already been claimed by another taxpayer then your only recourse is to file a correct tax return, claiming what you are entitled to claim, then print and mail the return.

The IRS will process both returns and pay any refunds. Shortly (within a year) the IRS will mail letters to both taxpayers asking if their tax return was filed in error and suggesting that they amend if they improperly claimed the child.

If neither taxpayer amends, the IRS will send a second letter asking for each taxpayers proof that they are entitled to claim the dependent, such as proof that the child physically lived with them more than half the year. School records, child care records, household receipts, medical bills, etc., that show that the child lives with you should be retained.

The IRS will evaluate each taxpayers claim and award the dependent to one taxpayer, the other will have to payback any refund received plus interest and possible penalties. The taxpayer that had physical custody usually always wins.

Do not ignore the letters or you will loose.

This happened to me the other parent claimed them so I went and got tax professional help she told me to file single because I would get denied trying to claim them then to then when I get my taxes back we would do an amendment paper form and send proof that I'm custodial

You have two choices. 

1) E-file without claiming the dependent, then fie an amended return claiming the dependent after your original return has been processed.

OR 

20 File your original return claiming the dependent. If the dependent has already been claimed, as you say has happened, your E-FILE will be rejected. You will be forced to print and mail your return in. 

 

Once the IRS sees that the child was claimed by two different taxpayers, they will investigate and determine who has the right to claim the child. 

The person that claimed the child, and shouldn't have, most likely will face penalties,

interest, and additional tax.

So im currently in between jobs, left last one in January.. my son and I are living with my father & have been for the 2020 tax year. He is trying to claim my son without my permission on his taxes.. im afraid this will mess with any government assistance we may get.. does it? Also what happens if I claim my son as well?

If someone else claimed your dependent already, then your e-filed return will be rejected.  Print, sign and mail your own return which claims your dependent.  Mailed returns are processed differently by the IRS.  It will take some time (maybe even up to a year) but eventually the IRS will contact both parties and sort out who could rightfully claim the dependent.  The person who wrongfully claimed the dependent will face repayment of refund $, plus penalties.

 

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s.  Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

would I be able to walk in & have someone file my paper return for me? or would I need to print it & send it out myself?

TurboTax  doesn't have any brick and mortar stores  so  if  you  upgrade to any of the LIVE options the return will be done virtually not face to face and the final return will either be efiled  or  YOU would need to print, ink sign and mail it.

I filed my taxes and received them and then filed an amended return, will it still work out for me or do I have to do something different?

Assuming you are trying to determine if you need to do something different with your amended return, as long as you file it, you would not need to do anything else unless you had a payment due with the amended return.


If that was the case, make sure you also sent payment as indicated with the amended return.

 

Otherwise, the IRS will process your amended return and issue you a refund, if applicable.
