If you are named on the birth certificate then you can get a duplicate birth certificate from the issuing authority with proper identification.

If you have read the entire conversation above, you will note that, from a tax standpoint, the children either needed to have lived with you for at least 6 months and 1 day out of the year (or more than half of the remainder of the year in the year a baby is born) for you to claim them as qualifying children.  If you did not live with any of them for half of the year, you can still claim the children for the Child Tax Credit ($2000 credit) if the mother provides you with Form 8332.  No matter how you are able to claim the children, you will need their Social Security Number to do so.  There is no provision in the Tax Code that obligates the mother to provide you with this information.  If she is not providing this information to you, you may wish to seek legal counsel to see what options you have, which is out of scope of what information we can provide on this Forum.

so, we have lived together for 3 years(the entirety of my childs life). now she thinks she can claim her as a dependent, even though by law i have the right to do so. so i was subverting her, and started to do my taxes, went to claim her they asked for her social security card info, well now she is refusing to give it to me and has hidden all paper work regarding my daughter. IS THIS LEGAL? In the midst of this pandemic their is no way for me to get the paperwork from the social security office and im not sure which route to take. maybe just not claim her this year and come back next year better prepared?

Did you claim her last year?  How did you do the return?  Get a copy of last year's return.  It would have the SSN for your child.

I filled out an S5 form to recover my son’s social security card. On that form it asks for his social security number.  I’ve never obtained a card for him. My son’s mother has always had it. 

This past year we went to court and I now have joint physical custody. I pay child support and get him 50% of the year.  So I know want to claim him this year but I don’t have the social and she refuses to release it to me. 

How should I go about this?

You need to speak to your attorney as the Court may have to order her to give you the SSN.
