I'm having trouble too, Katie. Trouble is if I change my tax return and the expert is wrong then I have to change it back to the way I had it. A big hassle.

The intent of the last minute unemployment waiver provision was to benefit the unemployed worker during this crisis. It was not intended to be punitive, which to a very small group of taxpayers it is. I.e., those who paid full health premiums each month, took the year end PTC, AND whose income dropped below the PTC range as a result of the retroactive provision.  As such, I do not believe that there explicitly states in the provision that taxpayers are required to take the exemption and complete the Unemployment Exclusion Worksheet if the result is not beneficial.

 

At question is also the legality of the retroactive nature of the provision.  For example, if retroactive tax changes happen each year, it becomes impossible to project AGI with respect to PTC subsidies as any retroactive changes to what is and is not considered taxable income would move individuals in and out of the PTC range with no ability to plan during the year.  In my case, I take a IRA withdrawal each December or make a contribution if needed to get into the PTC range.

 

Additionally, IRS has just provided guidance with respect to the PTC and stated that if your income dropped beliw the PTC range in 2020 (due to the unemployment waiver or any other reason), the taxpayer would not have to repay any excess Premium Tax Credit,, however, they did not address the taxpayer that pays the full monthly premium and takes the year end credit (small group of people, but a population nonetheless).

 

There are a few other issues and unintended consequences as a result of the last minute unemployment exclusion provision that I will not bore the community with, but I am currently working with the Sytemic Tax Avocacy group of the IRS to address these issues and am hopeful additional guidance will be forthcoming.

Your analysis is impressive, and it sounds like you are taking appropriate action with the Tax Accuracy Group of the IRS.  But I fail to see how TurboTax can assist you.  We are obligated to conform to current tax law.

My hope in posting the comment was that if there were other Turbo Tax customers  that are in my situation, had their refunds/amount owed negatively impacted by the Unemployment provision or those that simply shared my concerns, that they would also post, which may then prompt Turbo Tax to raise the issues or request additional guidance from the IRS, as I am doing - I have to believe that this issue affects more people than just me.  I also cannot amend my return because the numbers currently in TT  (after the auto recalcultion) do not match the numbers that have already been submitted and processed by the IRS.

I Turbotax (FY2020) filed in February 2021 before the "Exclusion" law. I have had NO TRACTION on adjustments on my file with the IRS. These adjustments (refunds) were to start flowing in late May. 

Is IRS advice of those like me to still not file and amended return. 

Would you advise visiting a Taxpayer Service Center?

No way to track it.  Just keep waiting.  The IRS is sending them out in batches over the summer.

 The IRS is recalculating refunds for people whose AGI is $150K or below and who filed before the tax law that changed the amount of unemployment that is taxable on a federal return became effective.   

 

 

The IRS began to send out the additional refund checks for tax withheld from unemployment in May.  The refunds are being sent out in batches—starting with the simplest returns first.   If you are eligible for the extra refund for federal tax that was withheld from your unemployment the IRS will be sending you an additional refund sometime during the next several months.  TurboTax cannot track or predict when it will be sent.  The IRS has not provided a way for you to track it, so all you can do is wait for the refund to arrive.
