My ex claimed my daughter for 2018 and 2019 and didn’t receive his or her stimulus check. It asks me if the amount received was correct from last year. Do I say yes or no?

It lists instead of the amount I received for 2018 and 2019 and lists the amount he received instead.

If you are claiming your child for 2020, you only enter the stimulus amount that YOU have received so far on your own tax return.  What your "ex" received or did not receive has no bearing on your own tax return.   

 

 

The stimulus money you get for claiming your children is based on your 2020 tax return.    When they hurried to send out checks last year they could not wait for people to file tax returns so they used either 2018 or 2019 information that was in the system already.   

 

But the credit was an advance on a credit you get on your 2020 return.   The way it worked means  in some divorce situations etc when parents "take turns" with claiming the child etc. a parent may have gotten the stimulus for a child based on their 2018 or 2019 return and they do not have to pay it back even if they did not claim the child for 2020.   But .....the parent who does claim the child in 2020 gets stimulus for the child---in other words stimulus is being paid out twice for the same child in many cases.  That is how they wrote the law.

 

You do get to claim all the stimulus money for round #1 and round #2 for the children who are claimed on your 2020 tax return.

According to the IRS, parents who are not married and alternate claiming of a child dependent, "The parent who claimed their child on their 2019 return may have received an additional Economic Impact Payment for their qualifying child. When the parent who did not receive an additional payment files their 2020 tax return next year, they may be able to claim up to an additional $500 per-child amount on that return if they qualify to claim the child as their qualifying child for 2020."

 

This only references the one stimulus payment but would apply to both.

This will all be done by claiming the Rebate Recovery Credit on your 2020 return.

 

You will want to enter the amounts of stimulus money you received.  If you are claiming the daughter in 2020 you may receive the stimulus payment for her.

So would I say no I didn’t receive the right amount and enter in that I received the full amount for the first round and only received the 600 for the second one? Then my ex will just have to claim the recovery rate for himself?

So just enter the exact amount that I received for the stimulus for round 1 and round 2?

Yes----enter what you received.   Let the software do its work.   If you should get the stimulus money for your child it will be added to line 30 of your 2020 tax return.   Stop fretting about what your ex got.  (or did not get).

Thank you for that information. Where can I find the Rebate Recovery Credit on your 2020 return in Turbo Tax?  It says in Turbo tax that I received the correct amount of stimulis because it was the amount for myself but not for my son that was claimed by his father even though i have him majority of the time.

You are only eligible for the Recovery Rebate Credit for children you are actually claiming as a dependent on your 2020 return.  If your son was claimed by his father in 2020, you will not get the Credit.

The stimulus check is an advance on a credit you can receive on your 2020 tax return.  If something went wrong or you did not get the stimulus check in 2020, you can get it when you file your 2020 return in early 2021

The Recovery Rebate Credit will be found in the FEDERAL REVIEW section. ( you should see "Let's make sure you got the right stimulus amount”)  If you are eligible it will end up on line 30 of your 2020 Form 1040.

 

Make sure that you enter ALL of the stimulus money received for the 1st and 2nd stimulus for yourself, your spouse and your children.
