@Kai6 All of that is unfortunate.  But the current stimulus checks are based on 2018 or 2019 tax returns, not your current situation or her financial need right now.  Your daughter made very little income in 2019 for whatever reason so if you claimed her as a dependent then she cannot receive a stimulus check and/or if she checked the box that says she can be claimed, she will not receive a stimulus check.

 

It does not sound like you have a valid reason to amend your 2019 tax returns.  If your daughter can somehow manage to earn enough to exceed the limit for you to claim her for 2020, she can get the stimulus money next year when she files a 2020 return in 2021.  For 2019 that amount was $4200.  For 2020 it will likely be $4250 or $4300.

 

You say she did not qualify for unemployment compensation.  Did she apply?  Never assume.  She should apply and see if she qualifies in your state.

Sorry since you already entered her ssn into your return and it was accepted she will have to mail her return this year to claim herself.  Even if you amend to take her off it will not release the ssn from the IRS database.   Or if she still qualifies as your dependent she needs to check the box on her return that says she can be claimed, then she can efile.

@chavela_96 You have added on to a thread that already has questions and replies from multiple users and it has become very confusing.      We do not know who had no federal tax withheld or if the person received a W-2, we do not know if it is your income, or your child's income....etc. etc. etc.-----please provide some specific details.

this just happened today - ugh.  I will let my daughter know she needs to file an amended return.  Will this affect the federal refund she received?

@sjbhermosa It might affect her refund especially if she has the recovery rebate credit for $1400 on line 30 of her return.  If she is a dependent on someone else's 2021 tax return she is not eligible for the $1400 and has to pay it back.

 

Even if she amends, your return claiming her cannot be e-filed this year.   It will be many months before the IRS processes her amended return, so you will need to print, sign and mail your own return.  

 

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s.  Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

Federal and state returns must be in separate envelopes and they are mailed to different addresses.  Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.

Thank you.  I do know she rec'd 1400 and wondered why she had such a big refund.  There ya go.  If we don't claim her this year and just let go of her as a dependent, I wonder how that will affect our return.  I don't think I can "play" with the numbers since I already submitted or can I since it was rejected?

Since your return was rejected, it has not been filed. You can remove the dependent and e-file again. You can both amend your returns later if you decide that you should have claimed her.

A child must always file their own tax return for income earned in their own name.  The only time you might include a child's income on a parent's tax return is if the income is only from investments, and under a certain dollar amount.

 

If the child has a job, they must file their own return.  This does not usually affect whether they are your dependent, but the child must answer "yes, I can be claimed as a dependent by someone else" as part of their tax return.

My 21 yr-old was a full time college student in 2021 and we claimed her as a dependent for 2021 and claimed the American Opportunity Tax Credit for her in the amount of about $2500. We are married filing jointly with AGI under $120,000. She earned income was $11,900 in 2021 and she had $0 unearned income. She did NOT file a federal tax return since her income was under the required amount and because we claimed her as a dependent. Here is my question. She had about $1000 in federal taxes withheld, but since she didn't file independently she didn't get a refund. If she filed an independent return to claim a refund for her federal taxes withheld, could we still claim her as a dependent and also still claim the American Opportunity Tax Credit or do we lose that credit if she files independently?

Yes she should file to get back the withholding.  It won't affect your return.  Be sure on her return she checks the box that says she can be claimed as a dependent on someone else's return.  

 

Online is only good for one return per account. But you can use the same email address for 5 accounts.
