How do I file taxes if my parents are not U.S. Citizens?

I am a U.S. Citizen, but my parents are not. I'm currently a student, but my parents support more than half of my financial needs. I have earned income before, so I do need to file my taxes; this is also my first time filing.

In Form 8615, I am asked to enter my parent's SSN, which they don't have. I am unable to continue without entering my parent's SSN. What should I do?

  • The IRS explains that your stipend may be reported on Form W-2 or Form 1099-MISC or even 1098-T or 1099-NEC. You are responsible for determining whether you were paid as an employee or independent contractor and whether or not the income is subject to self-employment taxes.

a w-2 would indicate you were paid as an employee making it earned income 

if it is earned income then you must meet all of these conditions to be required to file 8615

1. The child had more than $2,200 of unearned income.
2. The child is required to file a tax return.
3. The child either:
a. Was under age 18 at the end of 2021,

b. Was age 18 at the end of 2021 and didn’t have earned
income that was more than half of the child's support, or
c. Was a full-time student at least age 19 and under age 24 at
the end of 2021 and didn’t have earned income that was more than
half of the child's support.
(Earned income is defined later. Support is defined below.)
4. At least one of the child's parents was alive at the end of
2021.
5. The child doesn’t file a joint return for 2021.

 

 

further the 8615 instructions explain that  earned income includes wages, tips, and other
payments received for personal services performed.

 

you do not spcify the form you receive, who provides your support, your age, the character and amount of any other income. each of these could affect whether or not 8615 is required.
