Unless you are a US Citizen or Resident Alien, you should not be using TurboTax, as you need to file a Form 1040-NR, not a Form 1040.  TurboTax does not support Form 1040-NR: U.S. Nonresident Alien Income Tax Return, but we have a partnership with Sprintax offering a nonresident tax filing solution to our TurboTax customers.

Visit the TurboTax/Sprintax site for more info or to get started.

There is no place on the return to indicate your residency status. If you are a resident alien, you would just complete the return and file it just as you would if you were a citizen.

Hi, my son was born in Canada but he resided with me in the US for the 2021 tax year and this is the first year I apply as a resident alien for tax purposes. Should i choose the US citizen or legal resident or resident of Canada or Mexico in the citizenship question. Thank you,

citizenship question

It depends. If 2021 was the first year your son came to live in the US then he likely would be a citizen of Canada, not the US.

If your son is a citizen of Canada and does not pass the Green Card Test or Substantial Presence Test, then you would choose legal resident of Canada.  If your son does pass either of these tests, then he could be considered a US Resident for tax purposes.

Thank you Vanessa, he was in the US for the whole 2021 year but he does not have a SSN or ITIN. We applied for adjustment of status and he should receive his EAD and then his SSN very soon. So I should choose "legal resident" for his Citizenship status, correct?

Yes, he would be considered a legal resident as long as he meets either of the tests as provided by our awesome Tax Expert @Vanessa A.  You should consider holding off on filing until he gets his social security number (SSN) since it should be soon, but not later than April 18th, 2022.  If you need to file before the SSN is received, you can write 'Applied For' in that spot.
