It depends. If 2021 was the first year your son came to live in the US then he likely would be a citizen of Canada, not the US.
If your son is a citizen of Canada and does not pass the Green Card Test or Substantial Presence Test, then you would choose legal resident of Canada. If your son does pass either of these tests, then he could be considered a US Resident for tax purposes.
