It depends on what the payment was for.  If the insurance settlement was for the cash value of your car because you totaled your car, and that was the only amount paid, lets say $3,000,  The $3,000 would not be taxable.  If the payment included an amount to cover a doctors visit or copay, that amount would not be taxable.

Now if the payment included any amount over your expenses for example pain and suffering, that amount would be taxable because it is considered income.

Yes, you will need to report this on your tax return, but if you did not have a gain on the payout, it is not taxable income.  So when you enter the 1099-K, you will follow the steps below to remove it from taxable income but still report it. 

 

To enter the 1099 K and then back it out immediately take the following steps:

  1. Income
  2. 1099-K under Other Common Income
  3. Enter the information from the 1099-K
  4. Check the box that says, This amount in box 1a is too high or includes some personal transactions
  5. Enter the amount that shouldn't be included
