Corrected 1099-S, Box 2 - Gross Proceeds $0 / Original 1099-S, Box 2 - Gross Proceeds $55,000 - Do I need to include any or both in my 1040 Form?

Vacant Lot was "fraudulently sold" using my ss back in May of 2023 for $55,000

Title company issued a 1099-S for this property and reported it to the IRS with my social security number.

Vacant lot finally recovered after reaching out to County Sheriff Department and case assigned to a Detective.

Attorneys for Title Insurance company transferred Title ownership back to me in December of 2024 through a Quit Claim Deed.

Title Company issued a Corrected 1099-S for $0 for this property and reported it to the IRS with my social security number in March of 2025.

Checked IRS website and confirmed both 1099-S forms are included in my 2023 IRS Wage and Income Transcript .

Should I report/include both of these 1099-S forms, the corrected 1099-S, or none of them on my 2023 1040 form?

That is correct.  You would not have any changes and you have NO income to report.  The old one was corrected to show no income.

If you included the 1099-S for $55,000 on your 2023 return, then you would need to Amend Your Return for 2023. 

 

 If you did NOT report the income on your 2023 return, then you would not enter the one for $0 on your return.  You would not do anything if you did not already report the income.

I apologize for not mentioning that I'm currently working on my 2023 Income Tax 1040 Form, and I have not filed my 2023 Tax Return as of April of 2025 since it took about 2 years to clear this fraudulent sale, get my property back, and persuade the title company to issue a Corrected 1099-S (the Title company just got it done in March of 2025 and the corrected 1099-S is now shown in the IRS 2023 Wage & Income Transcript.)

 

Fortunately, I'm due a Tax Refund for 2023 and even though I had to wait 2 long years, I got my property back...

 

Hope this clarification helps a bit

Ok, so you do not need to amend but you do not need to enter the 1099-S on your return since the corrected one shows $0.

No need to amend the 2023 1040 Form, since it has not been filed.

No need to include/file the original 1099-S showing $55,000 issued back in 2023 in my 2023 tax return either.

No need to include/file the Corrected 1099-S showing $0 issued in March of 2025 in my 2023 Tax return either because the IRS has a record of both of these 1099-S forms, right?
