Am i being taxed by the state for paid family leave?

My paid family leave came on a 1099-misc form instead of a 1099-G. I usually get a refund from the state but this time I owe. Am I being taxed for paid family leave because of the type of form it came on?

Yes, paid family leave is taxable. The reason that you owe is likely because the state does not withhold tax from this type of payment.

I had federal deducted...I thought state tax wasn't applicable to paid family leave in NYS?

Each state has different rules but New York State Paid Family Leave states clearly:  

  • Any benefits you receive under this program are taxable and included in your federal gross income.
  • Your employer will not automatically withhold taxes from these benefits; you may request voluntary tax withholding.
