A lawsuit settlement of $3.10 for back wages was received as a 1099-MISC and TurboTax has it as a schedule C, is this even right? If so, what is the business code?

The settlement came from my employer during the year. Should this be categorized as a business?

No, it should wind up on line 7 of your return, for Wages. What box was this $3.10 entered on? Assuming it was reported in box 7, enter your 1099-MISC, then on the screen Describe the reason for this 1099-MISC enter lawsuit settlement, or back wages. Next, on the screen Does one of these uncommon situations apply? check This was money from a lawsuit settlement, and then answer yes that it was for back wages, then enter the amount. See the screenshot.

That should place your 1099-Misc in the correct spot on your return, and no Schedule C will be necessary.
