3% withholding for land sale in Georgia:

I’m having difficulty filing a Ga.State income tax form.

In 2022 my family and I sold vacant land in Ga. we where non-residents and the closing attorneys withheld 3% of the sale price. My sister who had an income of 65k told me her CPA was able to get back all her withheld sales tax. When I fill out the GA. Income tax form on the TurboTax program it tells me we owe money. 
My sister says that her CPA said Ga. has very generous tax withholding refunds for people over 65 years old. We are both over 65 and my wife and I file jointly with double the income of sister who is single.

3% withholding for land sale in Georgia:

Be sure that you have entered the taxes that were withheld for Georgia as part of your Federal tax return.  The information about the withholding will then transfer to your Georgia return.

 

Use the following steps:

 

  • On the top row of the TurboTax screen, click on Search  
  • This opens a box where you can type in “other withholding” (be sure to enter exactly as shown here) 
  • The search results will give you an option to “Jump to other withholding
  • Click on the blue “Jump to other withholding” link 
  • Scroll down to Other Income Taxes Paid in 2021
  • Click Start beside Withholding not already entered on a W-2 or 1099 and then answer 'yes'
  • Be sure to enter the information in the second line of data and choose Georgia in the drop-down box

Please note this is TurboTax premier desktop 2022. On your instructions it’s notated for 2021 but does not seem to work for 2022 desktop.

Yes, the Jump to links don't always work. Here is how to enter it in TurboTax Desktop:

 

  1. Select Federal, then Deductions & Credits.
  2. Select I'll choose what I work on, on the right. 
  3. Scroll and find Estimates and Other Taxes Paid.
  4. Select Other Income Taxes.
  5. Scroll down and click Start to the right of  Withholding not already entered on W-2 or 1099 (near the bottom).
  6. Answer the first question Yes. 
  7. Under State withholdings, select Georgia from the dropdown menu and enter the amount of Georgia state tax withheld.
  8. Click Continue in the bottom right corner and proceed with you return.

We found the appropriate “other withholdings” filled in the information it still says we owe taxes.😢😢

When we go to Ga. State taxes page it it goes getting back $655 to you owe $150…

Follow these precise steps. You should receive a credit for the taxes that were withheld on your Georgia state return.

 

  1. Go to federal>deductions and credits
  2. Go to Estimates and Other Taxes paid>estimates
  3. Go to State Estimated Taxes for 2022
  4. Answer yes at the first screen
  5. Then you will reach a screen that says 2022 State Estimated Tax Payments
  6. Enter the payment in any one of the quarters.  Click the drop down first and select  Georgia. 
  7. Enter the amount of the sales tax paid and you should now see a difference in your Georgia State return.
