2020 Taxes - Dependent - no income, full time student but turned 24 August 2020

It looks like Turbo Tax allowed me to claim my daughter on my taxes in 2020.  She was a full-time student with no income but she turned 24 in August 2020.  I assumed 2021 would be the first year I was unable to claim her.  But now I think this is incorrect based on my research but it contradicts what Turbo tax allowed.

2020 Taxes - Dependent - no income, full time student but turned 24 August 2020

There are two types of dependents --   Qualifying Child or Qualifying Relative.  Even if she was too old to be a qualifying child it is possible for her to be a qualifying relative if she had less than $4300 of income.

 

 

WHO CAN I CLAIM AS A DEPENDENT?

 

 

You can claim a child, relative, friend, or fiancé (etc.) as a dependent on your 2020 taxes as long as they meet the following requirements:

Qualifying child

  • They're related to you.
  • They aren't claimed as a dependent by someone else.
  • They're a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
  • They aren’t filing a joint return with their spouse.
  • They're under the age of 19 (or 24 for full-time students).
    • No age limit for permanently and totally disabled children.
  • They lived with you for more than half the year (exceptions apply).
  • They didn't provide more than half of their own support for the year.

Qualifying relative

  • They don't have to be related to you (despite the name).
  • They aren't claimed as a dependent by someone else.
  • They're a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
  • They aren’t filing a joint return with their spouse.
  • They lived with you the entire year (exceptions apply).
  • They made less than $4,350 in 2021.
  • You provided more than half of their financial support.

When you add someone as a dependent, we'll ask a series of questions to make sure you can claim them. There may be other tax benefits you can get when you claim a dependent.

If she was under 24 on 12/31/2020 and a full time student you could claim her no matter how much she made.  But since she is over 23 you can still claim her if she made less than $4,300 for the year.  So you're ok.  You might still be able to claim her in 2021 if she made less than 4,300.

@rdarragh33  She can be claimed as a qualifying relative if you meet these requirements: Your gross income is less than $4,300.  You may want to look at IRS rules here.  https://www.irs.gov/faqs/filing-requirements-status-dependents/dependents/dependents-2
