No, you do not have to file a state return just because it was incorrectly listed on your 1099-R. (The only reason to file in that state would be to get a refund of tax withheld).

 

While this is not critical, you might want to contact the issuer (again?) and ask them to remove it from your account record. If you do this, I'd suggest a letter, with proof of mailing and return receipt.

 

If that state ever contacts you about the matter, just tell them you aren't a resident, the 1099-R is incorrect and you have asked the issuer to correct the problem.

One of my 1099-R forms has an incorrect state in Box 15. The issuer refuses to issue a corrected 1099-R for the 2021 tax year.  How do I report the taxable income from that incorrect 1099-R (with the incorrect state), to the correct state?

@JM1812  If there is no money with held in box 14 or box 17 then you should simply change the state in box 15 to the correct state as though the form had been corrected.  You say the issuer refuses to correct the problem - follow @ToddL99 's advice above and send a letter to the issuer requesting the change.  Save a copy of the letter and proof of delivery.  Then you're covered if it ever comes up down the road (which it most likely won't).

 

If there is money with held in box 14 or 17 then you will need to file a return in the incorrect state to get that money back.  It will be a non-resident return and it will have to be paper filed with an explanation attached.

How do I file with a incorrect state listed on my 1099R

Why was it incorrect? The question is, was there an amount in box 14? Then you have to contact the pension administrator and ask if they actually sent money to the state in box 15? If so, then you will need to file a non-resident return for that state to get your money back.

 

But if there was no amount in box 14, then you can just delete box 15 (and 16).
