I live in PA, work for NYC company as a mostly remote employee. For 3 months building was closed due to fire. Do I still pay NY tax for those 3 month telecommuting days?

Note -- I am familiar with NY telecommuting tax law -- that a remote out-of-state telecommuting day is still a NY tax day. In this case, I had no physical place to work in NYC for the 3 months of post-fire reconstruction.

Check with your employer as to how they are handling it. If you do not claim NY income for those three months and get audited, you’d have a stronger position if your company backs you.

 

Among the facts in the convenience of the employer test is: The employer does not provide the employee with designated office space or other regular work accommodations at one of its regular places of business.

It certainly seems you were performing remote work for those three months due to the necessity of the employer.
