As a non US CITIZEN resident, can you set aside $3 of your taxes to go to the Presidential Election Campaign Fund on the Form 1040 federal income tax return? It is legal?

If you are a U.S. resident alien, then you can contribute to the Presidential Election Campaign fund.

 

The Federal Election Campaign Act does not prohibit individuals with permanent resident status (commonly referred to as “green card holders”) from making contributions or donations in connection with federal, state or local elections, as they are not considered foreign nationals.

 

Nonresident aliens file Form 1040-NR or 1040-NR-EZ. There is no $3 Presidential Election Campaign fund box on these forms. If you are a nonresident alien, use Sprintax to prepare you taxes.
