Can I file a 540

Hello all,

 

I'm currently stationed in Japan... California is home. I'm trying to take online classes at my local community college back home but it specifically requires a 540 and NOT a 540NR in order to recieve in-state tuition. 

 

My online source of income is the military.

 

Am I allowed to file a 540 anyway to provide to my school as proof of residency?

Can I file a 540

If you are military and your HOR is CA, then 540 is the correct form to file. If you are permanently stationed outside of CA, your military pay is not taxable to CA.

Amy,

I already filed my taxes and the form I got back was a 540NR.

 

I'm not sure if 540 was supposed to be attached, or whether I should be filling out a 540 to submit after the fact.
