My husband is active duty, currently residing in HI. His home of record is Louisiana. Would he claim the military pay exclusion?

Yes, he would if he is filing a Louisiana resident return and was outside of Louisiana for 120 or more days.

 

In TurboTax, after your husband enters his W-2, then next screen (ignoring any "congratulations" messages) asks for a number of items, and the first is whether or not this is military pay.

 

Be sure to check this box, because this is what tells Louisiana that this is military pay.

 

Then, in the Louisiana state interview, you will see a screen with the heading "Enter Military Information". On this screen, indicate that "Louisiana is my home of record", "I served on active duty orders" (if true), and "I served on active duty outside Louisiana for 120 days or more" (also if true).

 

Answering these questions correctly should invoke the Louisiana exclusion.

 

NOTE: to see this Louisiana screen, you must have indicated in the Personal Info that you lived in Louisiana (your home of record); otherwise, you will be offered a non-resident return in Louisiana which does not have the exclusion.
