The IRS uses your prior year AGI to combat fraud. You can find your 2023 Adjusted Gross Income (AGI) by: Looking at line 11 on page 1 of your 2023 Form 1040 Requesting a transcript of your 2023 tax return from the IRS. You can request your transcript online at the following link: Get Transcript Please click on this TurboTax article for more information. Check these items as well to ensure you have the correct number. If you: Filed late last year after mid-November or your return was processed after that time—try entering 0. Amended your return last year—make sure you’re using the AGI from your original return, not the amended one. (If you only have a 1040X form, it’s on line 1, column A). Rounded your AGI to the nearest dollar—be sure to round up when it’s 50 cents or more and down when it’s 49 cents or less. Filed with your spouse last year—you and your spouse have the same 2023 AGI. (Don’t split the AGI amount or enter 0 for one of you). Time-saving Tip: If what you entered is correct and you continue to get a reject, you won't be able to e-file. There's probably a data mismatch at the government, or some other situation beyond your control that prevents your return from being e-filed. In this case, your only option would be to print and mail in your return. This article will give you instruction on how to print and mail your return.

If you read the instructions for 8938, it says: ---------- Duplicative Reporting You do not have to report any asset on Form 8938 if you report it on one or more of the following forms that you timely file with the IRS for the same tax year. Form 3520, Annual Return To Report Transactions With Foreign Trusts and Receipt of Certain Foreign Gifts (in the case of a specified person who is a beneficiary of a foreign trust, see Part III of Form 3520 and its instructions). Form 5471, Information Return of U.S. Persons With Respect to Certain Foreign Corporations. Form 8621, Information Return by a Shareholder of a Passive Foreign Investment Company or Qualified Electing Fund. Form 8865, Return of U.S. Persons With Respect to Certain Foreign Partnerships. Instead, you must identify on Form 8938 the form(s) on which you report the specified foreign financial asset and how many of these forms you file. See Part IV. Excepted Specified Foreign Financial Assets, later. ---------- Their use of the word "must" suggests that it is NOT an option to just duplicate the information from the 3520 on the 8938 and not report that you've also filed a 3520.

E-file the return, then, within 3 business days of receiving IRS acknowledgement that your return was accepted, mail form 8332 (completed by your ex) along with form 8453 (search forms in Turbo Tax or online). https://turbotax.intuit.com/tax-tips/family/what-is-form-8332-release-revocation-of-release-of-claim-to-exemption-for-child-by-custodial-parent/L25kdeRnR If you have custody of your child but want to release the right to claim your child as a dependent to the noncustodial parent, you’ll need to fill out Form 8332. All that’s needed is your child's name, the tax year, your Social Security number, then your signature and date. If you prefer to release your claim for more than one tax year, enter the same information in part two rather than part one. You also use the form to revoke a previous release of a claim. Once complete, give the form to your child's noncustodial parent, not the IRS. They will file it with their tax return. If you release your claim for multiple tax years, you only need to fill out the form once: the other parent will attach copies of the original to their return each year.

You actually have 2 options. You will find this by going to Other Tax Situations>>Underpayment Penalties
First option is as you walk through the steps select yes to do any of these apply to you?
Your underpayment was due to a casualty, disaster or other unusual circumstance
One of you became disabled
Then walk through the steps to request and explain why you are requesting the waiver. This would actually be the better way to do it.
If you select no to that question you will be asked if you want to let the IRS figure your penalty.
