Do I qualify for the Lifelong Learning Credit if my employer pays the school directly?

I have a signed Continued Service Agreement with the employer, must pass classes with an A or B (and submit proof to my employer), and if I leave prior to completion I must reimburse the entire cost of the program to employer. I've seen varying answers on this that only added to my confused. To me, it's like a reimbursed agreement in that if I don't pass a class, I owe the employer the money spent out of my pocket. If I pass without issue, they're just removing me as the middle man and paying the school directly.

The bottom line is that you can't claim a credit for tuition your employer paid. If at some point, you have to repay the employer, then that is a different issue.
