If based on your income and what you entered on your tax return you were entitled to the stimulus and you did not receive it then it should be added to your refund. That is what the IRS required.
Why do you think that is wrong?
Because it was not part of my income as my ex had the money and did not give me any of the stimulus moneys that came last year. That was a specific question asked when filing my taxes. So, when i selected that I did not receive the moneys, TurboTax gave me the stimulus money as part of my return, but that is not correct according to the IRS. The IRS says that disputed stimulus money between a couple is a civil matter and TurboTax should have never added it to my refund.
The IRS is not going to get involved in the civil problems you have with your ex-spouse. And TurboTax cannot know that you are having trouble with your ex spouse. The interview screens that ask about income do not ask if you can trust your ex, soon to- be ex, or make provisions for such problems. The point is that those stimulus payments were issued to your Social Security number, so if you told the software you did not receive the payment that was not really true. The payment was issued to you, but you just could not/did not get it from your "ex." You cannot get it twice or blame a software program for the problem. If your ex-spouse kept money that you think is yours you can get your divorce attorney involved.

@camochic98 Since you have not provided any details----was the 1st stimulus actually seized for child support you owed to your ex-spouse? Is that why you said the spouse got your stimulus money? Even if that is the case, you cannot then turn around and try to claim it as a credit on your tax return. Stimulus money that was issued in your name with your Social Security number was sent to *you* even if it was taken for child support. It would still be incorrect to say in the software that you did not receive the stimulus money. It would be a user error.
