Recovery Rebate

If the mother is your dependent, no, she cannot claim the stimulus. 

If the toddler is also your dependent qualifying child, you should get a stimulus payment for the child. 

 

If you mean the mother of the 17 year old, no, not if the 17 year old and the toddler are your dependents. 

The 17 year old dependent would not qualify for the first or second payments, but should qualify for the third stimulus.

The toddler would be eligible for the first, second and third payments.

Any portion of the stimulus which should have been received but wasn't, should have been included as the "Recovery Rebate Credit" on 1040 line 30 on your return if you claim them as your qualifying child dependents on your return. 

 

For the first and second stimulus payments: 

 

A qualifying child is a child who meets the following conditions:

  • Relationship to the individual who’s eligible for the payment: The child is your son, daughter, stepchild, eligible foster child, brother, sister, stepbrother, stepsister, half-brother, half-sister, or a descendant of any of them (for example, grandchild, niece, or nephew).
  • Child's age: The child was under age 17 on December 31, 2019.
  • Dependent of the individual who's eligible for the payment: The child was claimed as your dependent on your 2019 tax return or in the Non-Filers: Enter Payment Info Here tool.
  • Child's citizenship: The child’s a U.S. citizen, U.S. national, or U.S. resident alien.
  • Child's residency: The child lived with you for more than half of 2019.
  • Support for child: The child didn’t provide over half of their own support for 2019.
  • Child's tax return: The child doesn’t file a joint return for the year (or files it only to claim a refund of withheld income tax or estimated tax paid).

The payment will include $600 for each qualifying child listed on your 2019 tax return with a valid SSN or ATIN.

Thank you for your answer. Follow up question, my dependents no longer live with me, but I. recently received their third stimulus payments (the 1,400 each). Can I still claim recovery rebate for 1st and 2nd for the toddler? 

 

Also, we thought she wasnt included as my dependent, but the 3rd stimulus came out showing her as my dependent. What happens if she already submitted a recovery rebate for 1 and 2 stimulus for herself and the toddler? What should we do?

The Recovery Rebate Credit is based on your 2020 Tax Year return. 

The IRS used 2019 returns to send the stimulus payments since no one was ready to file for 2020 at that time (2020 wasn't over yet). 

 

Now people ARE able to file their 2020 Tax Year returns, and the IRS is using that to pay any missing first and second payments. 

If you missed any first or second payments, and you can't claim the people on your 2020 return, you no longer are able to get those payments. 

 

If you DID get the payments, you would not have to pay them back, but since you did not get the payments, you can't do anything to get them now.

Again, thank you so much for the answer. My final question is for the mother. Since she already submitted a recovery rebate for herself and her toddler, is she getting in trouble for it? what does she have to do now to cancel it, since she is not eligible to do that and cannot check the status online? Is she supposed to amend it?

Your 2019 return was apparently used for the third round payments you received.  The mother and daughter if not your dependents on your 2020 tax return will be able to claim the Recovery Rebate Credit on her 2020 tax return.  

 

She cannot see a status yet because her 2020 return has not been processed. 

 

She does not need to amend.  She just needs to wait for her return to be processed.

She doesn't cancel it because she is not claimed on another return and therefore gets the EIP.

Be nice and give her $1,400 you just got into your account.
