How do I report my daughter’s dad for claiming on her on his taxes illegally without my permission we’ve never been married we’ve never went to court and he is forced my child support do his job and threw me being on food stamps and Medicare and Medicaid with her and he got her stimulus money and he’s got all the child tax credit how do I go about getting the stimulus money for her and the child tax credit that is a

File your own tax return and claim your child.   Since the other parent already claimed her you will not be able to e-file.   But you can mail your tax return claiming your daughter and the IRS will process your return, and then they will sort out who can claim her.  If he claimed her fraudulently he will face repayment of any credits or refunds he received for claiming her, as well as penalties.

 

You do not say how many years he has been doing this, not have you mentioned if you filed tax returns during those years.   Have you had income from working?   Did you receive any of the stimulus checks for your child?   If you did not receive the 1st and/or 2nd stimulus for your child then file a 2020 return and use the recovery rebate credit to get the stimulus money for claiming her.   The 1st one would have been $500; the 2nd one was $600, so your 2020 return should show $1100 on line 30 for the recovery rebate credit.

 

To  get the 3rd stimulus of $1400 you have to file a 2021 return and use the recovery rebate credit....the $1400 will go on line 30 of the Form 1040.   And the $3000 child tax credit will be on line 28.   These will add up and go to line 35a for the refund on your 2021 return.

To file a return for a prior tax year

 If you need to prepare a return for 2018, 2019 or 2020 you can purchase and download desktop software to do it, then print, sign,  and mail the return(s)

You may also want to explore purchasing the software from various retailers such as Amazon, Costco, Best Buy, Walmart, Sam’s, etc.

 

Remember to prepare your state return as well—if you live in a state that has a state income tax.

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s.  Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

Federal and state returns must be in separate envelopes and they are mailed to different addresses.  Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.

 

Note:  The desktop software you need to prepare the prior year return must be installed/downloaded to a full PC or Mac.  It cannot be used on a mobile device.
