EIC

The program "awarded" us an EIC--but we do not have any children that are under the age of 40 years old.  I am thinking this is a mistake and I should file an amended return without the EIC.  Is that correct?  We are both in our 70's; receive Social Security monthly and I work part-time.  No children in our household.

EIC

EITC can be claimed even if you have no qualifying children, depending on how much income you have. If you have a small part-time job, it might be just enough to qualify you for EITC; in that case your Social Security probably isn't taxable.

Apparently you no longer have to be under 65 to get the EIC without children.  Turbo Tax is doing it right.

FYI  ... the EIC could delay your refund until the end of Feb or early March but it is legal due to the tax law changes.

I believe the change in age limits for EITC with no kids is only for this year thanks to the American Rescue Plan Act. If so, the old rules will be reinstated next year.
