According to Department of Revenue of New York, if you are a U.S. nonresident alien for federal income tax purposes and are required to file federal Form 1040NR, U.S. Nonresident Alien Income Tax Return, or federal Form 1040NR-EZ, U.S. Income Tax Return for Certain Nonresident Aliens with No Dependents,  you may be required to file a New York State nonresident return, Form IT203. 

To decide if you need to amend, please review https://www.tax.ny.gov/pdf/current_forms/it/it203i.pdf under U.S. nonresident aliens on page 49

You must attach a copy of your federal Form 1040NR, U.S. Nonresident Alien Income Tax Return, or federal Form 1040NR-EZ, U.S. Income Tax Return for Certain Nonresident Aliens With No Dependents.  (If you have already filed the form, you would want to re-submit a Form 1040-NR to IL)

You just need to amend your Form 1040 to Form 1040NR.  

 

Here are the steps:

You would need to submit both the Form 1040-X and Form 1040NR together:

  1. Download the Form 1040-X from the IRS website (see below).  On the front page of Form 1040-X, enter your name, current address, and social security number (SSN) or IRS individual taxpayer identification number (ITIN)
  2. Do not enter any other information on page 1.  
  3. Do not complete Parts I or II on page 2 of Form 1040X.
  4. Enter in Part III the reason why you are filing Form 1040X.
  5. Complete a new or corrected Form 1040-NR.  As TurboTax does not support nonresident forms, click here Sprintax.
  6. Across the top of Form 1040-NR, write “Amended”
  7. Attach the new or corrected return (Form 1040NR) to the back of Form 1040-X.

My New York state as well Illinois state taxes were also accepted. Should I filling amends for that as well?

Also I also had a form 8949 declaring my short term earnings for stocks. is there an amend needed there?

For states, it depends.  Please see answer below.  Yes, you need to include Form 8949 in your amendment.
