What should I do if an employer claimed he paid me when he didn't?

I had to take him to the labor board and won the case, but got less than the amount of what he claimed on the paystub.

I think you mean that the W-2 form you received reports the wrong income.

You should first contact the employer and request that they issue a corrected W-2 form. If that doesn't work, you need to call the IRS at 1-800-829-1040 and report the employer. In TurboTax, you should enter your W-2 and report the correct information and after you enter it you will see a screen that says Let's check for Uncommon Situations and check the box for the option that says Didn't get a W-2 (manually calculate my earnings). Work through that section and you will be instructed to complete a Form 4852 that you will need to mail with your tax return, that you will not be able to e-file.

He has to give you a W-2.   Does the W-2 match the correct amount?    Do not try to file a tax return using a pay stub.

the paystub is meaningless - you should have gotten a w-2. the paystub might not show legitimate deductions that the employer must make for FICA, Medicare, Federal and state withholding.
