Tax Return

Hello,

 

Just relocated from Europe under L1 Visa together with my wife and 2 kids all of them on L2 visas.

My question is, do I need to get ITIN number for all of them in order to include them in my tax return?

They are not eligible for SSN and my wife does not work, not 100% sure how to proceed.

Tax Return

EVERYONE listed on an income tax return MUST have either s SS# or an ITIN.   To get an ITIN you apply for it using the W-7 when you file the next income tax return.   The return is sent with the W-7 application and once the ITINs have been issued the return is forwarded for processing.   If you also need to file a state return you may need to put it on extension until the ITINs have been issued.

We do not have enough information about you.    If you are a non-resident alien then you will not be able to use TurboTax to prepare your tax return.

 

NON RESIDENT ALIEN  

If you are a non-resident alien, your return must be filed on Form 1040NR, which cannot be prepared using TurboTax.  You can use TT’s partner, sprintax:

Tax Return

I do live in the US long term so I believe that I'm considered Resident Alien.

I was also thinking that I have to have ITIN for my spouse and kids in order to include them in the tax return however the instruction form for w-7 it is stated that Dependents and Spouse can be claimed only for tax years prior to 2018 so I don't understand what that is supposed to mean and how do I need to proceed.

Also, according to what I read, I will not be able to get the ITIN numbers for my family before I'm ready to submit my tax return? meaning I need to wait until early next year and then submit W7 forms together with my tax returns?
