It seems you got confused about how to use this forum.  You have posted to another thread and have received replies in that thread.

Your other thread provided more details about your situation and the reply from Champ @Opus 17 provides some good advice.   Your former tax preparer gave you some very incorrect advice.  If you and your spouse were living together, you should never have filed as Head of Household, nor could you ever claim a spouse as a dependent.  

 

Going forward, please keep all of your questions in just one thread or it becomes too confusing for the people who are trying to help you.

I don't know what happened my question didn't post I have been married since 2002 and have always filed my taxes single or head of household claiming my two boys. My husband's always had legal issues so we've always kept things separate. After doing some research online even though I've had a tax preparer always do my taxes, that legally I didn't have the right to file single or head of household. How do I resolve this problem

You should  probably go to a local CPA or Tax Accountant to straighten this out.  You needed to file as Married filing Separate.  Did the tax preparer know you were married?  You might have been able to file as Head of Household if you didn't live with your spouse the last 6 months of the year.  And you might have been able to file a Married Joint return with an injured or innocent spouse form to protect your part of the refund.

My preparer was a tax accountant, and I assumed she knew we were married. We have lived together all these years but I've always done our taxes separately.When we first started with her my husband hadn't filed his taxes in over 9 years we weren't together or married at the time. That's why I chose to keep things separate.
