Single member LLC: California form 568

Hello,

 

I used Turbo tax (home and business version) to filed tax return for tax year of 2019. 

 

I have a single-member LLC in California, so I always reported the business income on the schedule C on the joined filing with my husband.

 

I just received a letter from California saying they can not find my tax return. Should I reply with the personal return information?

 

Or Do I need to file form 568? I have the SM LLC for a long time, this is the first time I got the letter from California.  It was not generated by Turbo tax software when I filed for the tax return.

D. Who Must File

An LLC may be classified for tax purposes as a partnership, a corporation, or a disregarded entity. The LLC should file the appropriate California return.

 

Form 568 must be filed by every LLC that is not taxable as a corporation if any of the following apply:

  • The LLC is doing business in California.
  • The LLC is organized in California.
  • The LLC is organized in another state or foreign country, but registered with the California SOS.
  • The LLC has income from California sources (Nonregistered foreign LLCs, see Exceptions to Filing Form 568, below).

An LLC is not required to file a tax return and is not subject to the annual tax and LLC fee if both the following are true:

  • The LLC’s taxable year is 15 days or less.
  • The LLC did not conduct business in the state during the 15 day period.

Are they asking for only the form 568  or the entire tax  return ???    Please read the notice carefully and respond accordingly with what ever they are asking for.
